Continuing CFs Thoughts:  :unamused:  The European Community (EC) and the United States have contrasting approaches to the place of member state liability to private parties as a remedy for the violation of the law of the union. The EC recognizes a general doctrine of member state liability in damages for violations of EC law, while American states generally possess sovereign immunity from private damage claims for violations of federal law. This contrast is paradoxical, as one would expect the U.S., a better established and more powerful federal polity, to have fewer concerns about the imposition of state liability than the less powerful and more fragile EC.
A cluster of differences between the EC and the U.S. helps to account for this paradox. These differences include the factual circumstances of their respective seminal cases; the historical settings in which they arose; civil law systems’ greater hospitality to governmental liability as compared to common law systems; stronger political control over judicial appointments in the U.S.; and EC member states’ stronger safeguards against unwelcome federal legislation. Collectively, these differences help to explain why state liability was deemed more important to the center and less threatening to the member states in the European Community than in the U.S.
Despite the many complexities involved in properly characterizing the European Community (EC) or the European Union (EU),1 both it and the United States may be called “federal” systems in a broad sense of that term.2 Both are multidimensional polities that recognize different levels of governance, each with the acknowledged power to regulate within a sphere of competence. In both, union law takes priority over member state law (supremacy),3 can be enforced in court against member states by private parties (direct effect), and thus obliges the courts of member states to treat the law of the union differently from conventional international agreements.4

Exactly what are the supposed ‘differences’ between US imposition and enforcement of Federal law v that of the EU ?.At the end of the day a foreign out of state majority gerrymandered Federal vote decides the laws and destiny of individual states with no right of opt out or substitution. In the case of the EU added to by the unelected EU Politburo/Commission elites. The issue being so important that the US killed around 7 million of its own people,by corrected real terms figures proportional with today,in a war to enforce that situation on states that tried to secede from it.

You obviously omitted the important bit two drivers working a 36 hour 3 day week v one working a 72 hour 6 day week.

As for roping and sheeting just like they do in the US :bulb: you’re off topic so no comment other than to say the ropes obviously can’t hold the sheet on.

If only this was true the whole EU would surely collapse, bring it on Buzzer.

Interesting few days to come Buzzer and I along with you and many others will sincerely hope that Boris can succeed and pull off his stated aim of leaving the EU on the 31st of October ! I was pleased to hear that he is going to kick out those spineless Tory MP’s who are threating to vote against Him ! two or three of them however are not standing at the next GE so will think they have nowt to lose but many of the others , I bet, will be having serious thoughts about losing all the perks of being an MP !!! I’ve just established that our local Conservative PPC, James Airey a local farmer and Councillor, is backing Boris to the hilt on Brexit so he will get my vote next time and we will hopefully get rid of that Lib Dem " J Arthur" Farron once and for all ! I also can’t wait to see that gruesome looking ■■■■ Rory Stewart , MP for Penrith and The Borders, get his arse kicked out and I’m sure his local Conservative organisation will not have been very happy with him anyway as they have always voted in a Tory over the years where Willie Whitelaw was the longstanding MP. Did you hear that slimy ■■■■■■■ Brown on tele this morning preaching doom and gloom ? What a ■■■■ that man really is ! he even had the gall to suggest that Scotland should be treated equally to England ! Oh! yea ! how will that pan out? every one Scots vote is equal to 10 English votes ! I also listened to that devious ■■■■ Blair and I reckon the wily ■■■■■ to give him his due, is onto Boris’s MO of laying a trap for Corbyn to drop into if an early GE is called and if the plan works Corbyn and his Commie Clowns will get a right ■■■■■■■ drubbing !! Bring it on I say ! Cheers Dennis.

See Hammond has signed himself on as a prospective candidate as he knows he is for the chop by Boris, just hope his electorate tell him where to do one the sniedy bar steward, lets hope BoJo gets the job sorted, Buzzer.

Let’s get this right.Bo Jo is supposedly a Leaver when he is actually on record as an EU supporter.

No surprise there was no sign of BoJo joining Davis in the Grassroots Out rallies as part of that.

Then he actually voted for May’s BRINO deal.

Then he allows the courts to sink the Tilbrook case.

Then he supposedly ‘prorogue’s’ parliament but ovbviously nowhere near enough to stop a remainer Lab/Libdem/Con SNP alliance from taking over parliament during the window of opportunity that he’s conveniently given them and thereby extend article 50 with the aim of reversing Brexit.

You know just like May needlessly throwing away her majority in an equally needless General Election rather than delivering Brexit.

As opposed to having prorogued parliament.

Then withdrawing the government’s defence of the Tilbrook case.

Then telling the EU we technically left in March we’re out no ifs no buts no deals and all done by the end of August.

Oh wait the Queen can’t provide to assent to any act which takes us out of the EU on grounds of sovereignty without implicating herself for signing the Act which took us into it. Prepare for the choice between BRINO or Remain just as Cameron ( and HM and the US government and most of all the lying scumbag Tory Party ) intended. :unamused:

At which point being an obvious attempt of an illegal non declared unrecognised non state to circumvent and replace Irish and UK sovereignty and replace,if not quash, the terms of the CTA as part of that.

Assuming that this country had a government and a head of state worthy of the name,we’d now be at war with the stinking EU and its French/German axis leadership,or at least in dispute with it under international law.In the absence of which this country is obviously ‘in distress’.

It would be interesting to know who you will vote for in the snap election CF by the sounds of it no one covers your views

Who is responsible for creating the Deal or no Deal option, as has been stated many times on here we just voted IN or OUT in 2016 and if this no deal scenario did not exist we would not have all this major trauma right now. Constantly we here every day these politicians against leaving the EU saying what BoJo is doing is undemocratic but so is not recognising the result of the Brexit vote of 2016, numpties Buzzer.

PS. could someone please exterminate that ■■■■■■ who keeps shouting out trying to block out TV interviews, is he on the dole ? he’s there every day shouting his gob off, obviously has no job.

You’re right. My ‘vote’ went with Gerard Batten.Who was chucked under the bus by the dodgy establishment, including Farage, partly because he was one of the only ones who realised ( or wanted to realise ) that the problem originates at Head of State level and he called her out on it.

On that note handing over the country to a foreign power was never an issue for a vote nor should even be up for negotiation regardless. The whole issue goes back to FCO 30/1048 and the Queen’s assent to the European Communities Act and therefore can’t possibly be fixed without implicating the Queen, especially if she knew about FCO 30/1048 when she signed us up to it ( likely ).

The ‘deal’ ( BRINO ) existed from the point when we voted out in being the EU quisling government’s default plan B option when Cameron’s one sided ‘referendum’ didn’t work out the way he’d planned.

On the basis that the Tories, like all the rest,had/have absolutely no intention of leaving the EU and they know the EU can’t/won’t possibly do any ‘deal’ which would risk it’s whole foundation, being based on cash and sovereignty in exchange for trade ( all in the EU’s favour ).So here we are 3 years later still an EU member state still with the only options on the table being BRINO or Remain. In large part to cover up the dodgy actions of HM in backing Heath’s treachery and to meet US geopolitical aims in which the US can’t afford to be seen to support secession from the EU ( what it sees as a USE ) being an organisation meant to be created in the US image and because any such support would also create obvious issues, regarding secession of states like Texas,at home.

Everything else in the form of the so called Leave side being an establishment diversion from all the above with the exception of Batten’s agenda and Hoey’s on the Labour side.No surprise that they’ve both been removed from the scene by the establishment making sure they never got into any real positions of power.Just like all the real deal leave politicians like Powell,Benn and Shore previously and maybe the jury still being out in Davis’ case.

Well that says all you need to know about Whitehall, Doctor Lee jumping ship to the lib dem side just like getting of one bus and on to another. Don’t know where he was elected but the people who put him in Whitehall put him there as a Conservative not a lib dem, he should have just resigned and there should have been a bye election. These MP’s who were going to vote against Boris are jumping ship so they keep there wages, losing the will to live now we definitely need a modern day Guy Fawkes with about ten ton of explosives then we can start all over again, Buzzer.

HI, IF YOU HAVE TIME watch on NETFLIX “THE GREAT HACK” it is about CAMBRIDGE ANALYTICA. or it may be on other networks.
I think you will get a lot of questions answered regarding the trump election win, also the BREXIT VOTE . how it was all manipulated, you may say its him again talking crap believe me ,your eyes will be opened even carryfast.peggydeckboy.

If we’re talking wall to wall propaganda and biased media brainwashing then it’s the pro EU Federalist rabble who are the experts. They have to be because they’ve got too much invested in the project to be otherwise.

As for Trump who cares, like Farage,he’s just another establishment shill and controlled opposition Federalist in the form of the president of the largest Federal government monster on the planet and who therefore by definition can’t be on the side of secession.Just ask any Texas Nationalist.

The Great Hack is just another machiavellian pro establishment propaganda exercise in that regard.

There’s nothing complex about a bunch of zb traitors who owe their allegiance to the EU 4th Reich/EUSSR wanting to hand the country over to that foreign power.

In this case using a laughably amateurish piece of reverse psychology and false flag propaganda, including pushing the bs diversion that the controlled opposition President,of the largest Federal zb up on the planet,is a supposedly a Secessionist who supports secession in Europe.I can ‘understand’ a Federalist/Soviet Machiavellian agenda when I see it.In this case largely to divert attention from and cover up the fact that the Queen signed us up to the European Communities Act in the face of FCO 30/1048.

Funnily enough - I’ve just finished a book called ‘The Perfect Weapon’ by David Sanger - all about the ‘Cyber War’ that has been happening in recent years - and yep, it mentions the Russian medling in both the US election and the Brexit vote. Evidently, the Russians have a large ‘cyber army’ - fake news, millions of Facebook posts as well as plain old espionage and computer hacking on a massive scale. Of course the Russians aren’t the only ones doing it…, but the book was one hell of an eye opener to me.

Well worth a read,

Cheers Keith

When is a majority not a majority ? When MPs say so , so shut up and all do as you’re told.
