Employment Tribunaral

I have the employment tribunaral today for BOYES CONNING/GJ COOPER/TINNELLY TRANSPORT, its been a long time coming, i got made redundant back in the tail end of october last year, and it’s taken this long to get a court hearing, Im cacking myself as to what the out come is gonna be,I’m just worreid that i’m not even gonna get half of what i’m owed. i’m owed over 1500 quid in wages and EXPENSES and nearly £3000 in redundancy
Has anyone evr been to one of these things and knows how they work, cos i’m just worried that i’m gonna get there and the judge is gonna rule that Tinnelly needs to pay, and give them 28 days or so to pay. But in reality they won’t pay, cos the couldnt even be bothered to pay in the first place.
Sorry if i’m talking rubbish its just that im nervus and could really do with the money right now.

I think it will be a case of turning up and staking your claim to the court officials.

Have they found the Iranian yet?

I took my previous employers to court like you are but fortunately it was all settled out of court a few weeks before which was lucky cus I never had no representation I was going to do it myself but it does look like you are going all the way and best of luck to you.

t’s a quite relaxed court, don’t expect to much of it, it’s not like the courts you see on TV or the criminal courts.
Hope you have your case well prepared, facts on paper and made a easy understandable, readable presentation of it.
They hate nothing more than little pieces of paper, ■■■ packets etc, with something scribbled on.
First they will put you in a waiting room, and the other party in another one, you won’t see each other until you go to the judge.
The judge will listen to your story (speak clear and use only facts no rubbish, and than listen to the other party.
After that you go back to the waiting room and the judge will try to make a decision, or let you know that he needs more time or evidence.
When he makes a decision, that is it, you have to accept whatever comes out of it as you cannot raise the same case again.

Sorry bald bloke i 've had a bit of a busy week since doing one thing or another.

Basically i have to go back for another hearing on the 17th or 18th October.
Tinnelly aparently have filled for insovency on the 28th of march this year, basically i think the liquidators of boyes conning, which sold the GOOD WILL i.e the contracts of the employees and the work contracts that Boyes Conning had left never got paid by Tinnelly, so i think the had an injunction put on them and then they (Tinnelly) filed for insolvency. Which for myself and the other employees would be better for us because we should get paid our expenses, outstanding wages, and redundancy money from the goverment, and not have to spend years chasing Tinnelly bloody transport!
We were also told that from the time that they took over and were paying our wages which i think was at the end of August beging of Septemeber, they never bothered paying any of our tax of NI, I havent been contacted by the tax office yet about this but i was told that a few of the old boys that decided to retire once everything hit a head in October have had trouble claiming there pension credits becuase of this. I was also told that there was a few other crimanal activites that had taken place, but i wont divolge to much on these because i dont know the full story, but put it this way, i reckon that Tinnelly Transport will finaly have what is coming to them :smiley:

I managed to find a job straight away cheers armagedon, i was very lucky.
Regarding u paying my wages expenses ect, there are regulations/laws in place that give employees rights in these kind of situations, so unfortunatley i have news for you and it’s all bad im afraid, the government will probably have to foot some of the bill, i don’t expect i will get all that i’m owed, but hey thats life. You also need to rememeber that I am also a fellow taxpayer, so your be pleased to know that it wont be just yourself, paying for all of the 80 drivers redundancy/wages/expenses :slight_smile:

Ask the lawyer for a High Court enforcement order,County Court has not much poke,to retrieve what was owed,and you can not pursue an individual,only the company and its trading name,even if the owner/s are multi millionaires or not.
They change their names faster than a whores knickers,easy way out,ABC International then ABD International,wipe out previous debts.

In an employment Tribunal case it is the Director who is made responsible not the Ltd company, and as in my case I had money ■■■■■■■ in long term investments with the banks which resulted in me having to pay £470 to go bankrupt to cancel my long term investments as it was the only way the banks would let me out of the agreement, so I could pay the Employment tribunal.

i get this sort of crap on a daily basis, “I pay your wages” etc etc etc etc :laughing: :laughing:

If they went busted, you will still be paid from insolvency office. That was my case I won against McLellan’s Transport [zb, one big zb were they :stuck_out_tongue:] but this is limited to 300 quid per week of wages they owe you.

Employment Tribunal awards are put in the same category as the Tax Man etc, prefferential, the only difference is despite being a limited company the Employment Tribunal can hold the Director directly responsible for the sum owed regardless of the Ltd status.

If it means baillifs to get the money awarded to the employee/s then baillifs it is, I was given 14 days to pay to the Tribunal which caused all the problems I encountered, as Royal Bank of Scotland insisted on 3 months notice to pull out of an investment so I could pay them.

Despite a director being bankrupt they still have the right to cease any assets they can regardless of what the LLP Practitioner says.
