'early' break question

is it legal to take a 15 minute break at 22.10 hours,after starting duty at 22.00 hrs? our dcpc trainer says you cannot have a break within half-hour of starting your shift.

you can take a break after 1 minutes work, if you card was in for that time

Some drivers prefer not to take the break right at the start but i shouldn’t see why you cant have a break, theres no minimum time :s

You can’t start or end a shift on break so there is a minimum of 1 minute really as above.

Is that ‘Should be in’?
Show us a rule where this applies.
Just because you have a motor, it doesnt mean you HAVE to put the card in if your gonna be sat in the canteen the whole of the morning :stuck_out_tongue: :grimacing:

The regs state that all your duties from the start to finish of a shift must be officially recorded

There is no rule that states because you have a truck available that the digicard must be in it but it is usually the easiest way

You might arrive at work and two trucks are being loaded and you will take out the first one that is ready to go …

are we talking driving time break or wtd break?
you can take 15 mins after 1 minute if you want, in order for it to count for the first part of a 45 minute break for your driving time you must have done some driving first even if it’s only 1 min
you can’t have a break from driving if you have done no driving
