Driving without insurance

I’ve been wondering what would happen if you were caught driving an O-licensed vehicle without [valid] insurance. Would the driver face criminal charges and/or a civil suit for any damage caused in the case of an accident, or would it be solely the operator’s responsibility?

The reason I ask is that, driving with an agency, I don’t think I’ve ever seen proof of a client’s insurance, and I’ve definitely never sat and read through the policy to check that it covers me specifically (with regard to age, licence details, shoe size, etc.).

Could anyone provide legal references?

Data from the MID is used by police to help combat uninsured driving. If your details haven’t been entered on the MID you may be stopped by the police. There’s a risk that your vehicle could be seized if the correct details haven’t been registered.

For private individuals it’s the responsibility of the insurance provider to get details of a policy or changes on MID within seven days of the effective date.

For company vehicles it’s the responsibility of the policy holder to ensure that their company vehicle details are provided for MID. To find out more about this please contact your insurance provider.

AIUI you’d be charged with driving without insurance but as it’s a company vehicle you’d have mitigation so you shouldn’t pick up the 6 points.

Show you care ,and ask to see the cert, when I was taken on by my current employer I asked to see the certs for the vehicle I had been allocated, life is a 2 way street, they had asked to see my docs :smiley: took them by suprise though.

No guarantee in doing that as they could be paying by installments and those can be cancelled at any time and I doubt if they will show you that the actual payments are being made

But in my defence I have taken all reasonable steps, I speak from past experiance, fined for using but operator done for useing, causing and permittting no insurance, me, £30 fine boss £1000 + interview with the commisioner as it was in those days.
