Hi all, I havent been on the forum for a while thanks to a computer failure.
Some of you may remember that I started delivering cars on trade plates a few months ago, bit of a cack job but any port in a storm and all that… Anyway Ive been asked to collect and deliver a brand new, unregistered 7.5t chassis cab, however I dont posess a digicard. Im assuming that this means I cant drive it and this is what ive told the gaffer.
Am I right in telling the boss I cant drive it? Is there any penalty for him if he talks anyone else in my position into driving a 7.5 tonner without a digicard? What would the penalty for me be?
Im sometimes asked to move mini-buses fitted with digicard tachos, they are not that big, Iveco Daily sized infact. Can these be driven without a tacho card and without a PSV licence (when empty) I was told that because im not carrying passengers Im OK. Is there any truth in this? Again, if Im in the wrong what would the penalty be?

To be honest mate, I would call DVLA for the licence required and VOSA for info on the digi to get a definitive on what you are doing as it sound very IFFY to me.
IF it is illegal then there will not be any valid insurance on the vehicles driven so you could potentially get done for no insurance and Driving otherwise than in accordance with a licence
That would be a lot of points and a fine of at least 3 figures
Speaking the VOSA sounds like the best option, however driving without a digicard must be an offence in itself? Ive just had a message from the gaffer and he said its ok as its unregistered, im guessing that the digitacho wont have been calibrated.

Spot on!
Any vehicle which falls under the scope of tachograph regulations, whether it be new, used, digi or anologue is exempt from the need to record activity by use of a tachograph if, and it is IF it is being driven for the purpose of delivery (of the vehicle, not goods obviously!)
if memory serves me correct you are exempt from all tacho regs when driving a vehicle under trade plates, but you will need the correct class on your licence eg. c1 for the 7.5 tonner or d1 for the minibus, and this will depend on when you past your car test to wether you automatically have them or if you need to take another test to get them i hope this helps if i am wrong someone is bound to put me right lol

DVLA cannot give legal advice on how vehicles are classified but, generally speaking it depends on the weight of the vehicle or the number of passengers it can carry.
Any queries should be directed to the DVLA on 0300 790 6801 and lines are open Mon - Fri 8am - 8.30pm and Sat 9am - 5.30pm
It is done firstly by weight but then superceded by the number of seats.
EXAMPLE : -
A 4 tonne transit is a C1 LGV but if it has MORE than 9 seats (including that of the driver) then it becomes a D1 PCV

I’m no expert on the laws regarding trade plates but I would imagine that you would still have to have the relevant licence catagory for the type of vehicle being driven.
