I work for a recovery firm. So most of the time we do not use a tacho (with in the 100km rule). So do I have to stick to the 45m break every 4.5 hours? The reason I ask is that I can be in the yard for 2.5 hours, just when it is break time I get called out and might have to drive for 4.5h stright. Some times this involves loading something, but not for long.

Working within 62 miles of base and you can drive for nearly 4.5 hours on a recovery, presumably you recover HGVs ?
Anyway there’s no requirement for the 45 minute break under domestic rules, you’re just required to have appropriate breaks.
You still come under the general WTD so should not work for more than 6 hours without a break of 20 minutes, but missing this isn’t as serious as not complying with the drivers hours rules

Thanks for that. That is what I wanted to hear.
I have not started doing the HGVs yet, just cars and big vans. But it on the list to learn!! I am driving up to 18T right now, but there is a 25T tractor unit with twin 35T winches that they are going to let me lose on soon
