Driving Hours

I’m starting nights Monday to Friday with a 20:00 start soon and I’m a bit confused.

If the working week is 0000 Monday to 2359 Sunday and you have to have a 45 hour weekly rest within that week, how can I do this? Say I start Friday night and do a 12 hr shift. 0800 Saturday til 2400 Sunday is 40 hrs. Obviously I won’t start work til 2000 Monday making 60 hrs total but it doesn’t line up with the working week as stated in the rules. There are plenty of examples for mid week rest periods but none that are spread over the two weeks.

You have nothing to worry about. A weekly rest that spans 2 working weeks can be counted in either week but not both. If you’re having 60 hours off every week then you’ll be fine.

That word should be IN not WITHIN

Within means to fit inside
In means that as little as 1 minute can be in a fixed week in order to be used for that week

Most people regard the working week as the week you work, say you work Tuesday to Saturday that’s your working week, the fixed week is 00:00 Monday to 24:00 Sunday

The whole weekly rest period doesn’t have to fit into a fixed week, if you finish work at 08:00 Saturday and restart work at 20:00 Monday you’ve had a 60 hour weekly rest period, a weekly rest period that crosses 2 fixed weeks can be counted for either week but not both.
