Driving Hours Help Wanted

I finished a full Weekly Rest at 14.20 on Friday 12/10 and worked till 23.35.
I next worked Sunday 14th 10.40 till 22.55.
Then Tuesday 16th from 18.20 till 05.55 the next morning,followed by Wednesday 17th from17.30 till 05.15 this morning.
They want me to work from 16.30 tonight till about 05.00 tomorrow.
Can I do it and if so, when do I need to start my next weekly break?

A full weekly rest was counted for the week ending sun 14/10/2012

A reduced weekly rest for the week ending sun 21/10/2012 was taken between sun 2255 to tue 1820 = 43+ hours

The rules state that a maximum of 144 hours can be done between weekly rests so the answer as to when the next weekly rest must start is …

I realized when I was just dropping off to sleep that I had had a reduced rest Sunday to Tuesday. The break that starts 18.20 Monday must be a full one though, shouldn’t it, under that new rule that says one full break every second fixed week?

It can be if you want it to be or it can be a reduced one but you must start a full one no later than 2359 on sun 28/10/2012

Full for fixed week ending 14/10 = done
reduced for fixed week ending 21/10 = done
Full for fixed week ending 28/10 = see above when that must be started by

You can have extra weekly rests which count for no fixed week but must be there to prevent more than 144 hours being done between weekly rests

So when did this “new” rule get dropped in ?

I don’t know - I didn’t know about the rule until 2 months ago when the firm I was driving for gave me an infringement letter for taking two reduced weekly resta followed by a full one with compensation like I’ve been doing for years.
It’s in the Vosa Drivers Hours Booklet(GV262 03)revised 2011.
Quote - In any two consecutive fixed weeks a driver must take at least:
two regular weekly rests
or one regular weekly rest and one reduced weekly rest.
You still have 3 weeks to compensate for any reduced rest.

I will see if I can get a copy because as far as I am aware you can take two reduced rests provided there is a full rest either side of the reduced ones with compensation.

That is not correct in the way you said it

The word COUNTED is very important here as well as the word WEEK
COUNTED means at least 1 minute must be in the WEEK
WEEK is a fixed week from sunday midnight to sunday midnight

The weekly rest rules say (using my personal terminology) that a full weekly rest must be COUNTED for at least every other WEEK

Providing the driver has at least one full weekly rest COUNTED for every other WEEK and at least a 24 hour reduced weekly rest COUNTED for the WEEK which does not have a full weekly rest then the driver can have as many other reduced weekly rests as they like

The actual rules are written differently to that but the end result is the same

under the new regs the midnight rule doesnt happen anymore.
if your shift starts as yours did on tuesday 16th @ 18.20 then you dont have to legally take a weekly break until 18.20 on the following tuesday which is the 23rd. but to make this legal you have to have your 45 hour weekly break on top of the hours that you reduced your last break by. from looking @ your times you have supplied then you need to have a 55 hour break from tuesday but if you finish your workload on monday 22nd then you can simply have a 45 hour break before doing it all over again.

144 hours is tue 1820 to mon 1820 - not the following tue at 1820 :wink:

There was never a midnight rule for the weekly rests as far as I knew … :bulb: :confused:

Also payback for a reduced weekly rest only needs paying back in one go before the midnight of the sunday ending week 4 if the reduction was done in week 1
