can you help me please now i know some time ago if you started driving any time between 0000 and 0400 then you could only work a maximum of 10hrs as it was classed as a night shift,is this law still in place or does it not exist,help…

That regulation is very much still in place though I’ve no idea whether or not it’s enforced.

The regulation you’re referring to is part of the RT(WT)R 2005, if you do any work between 00:00 and 04:00 you are regarded as a night worker and are restricted to 10 hours working time, this can be opted out of if a workforce agreement is in place.

Please note that you do not need to start or finish work between those hours you just need for any part of your working time to be between 00:00 and 04:00.

The times I’ve stated above are the night time working hours for goods vehicles 00:00 to 04:00, the night time working hours for passenger vehicles are 01:00 to 05:00.

Seeing VOSA have openly stated that haven´t issued any FPN´s for WTD infringments, and nor do they intend to, it would appear it´s not enforced.

As they don’t check for WTD compliance in roadside checks and FPN’s are issued during roadside checks that would be why they haven’t issued any. :wink:
