Driver's hours scenario

Already been said that 28 days is the on the spot time limit, but 12 months for an office visit.
If the Ministry do an office records check they should see this offence. Difficult not to with digital records.
They will then probably want to see that the driver has had his sin explained to him, and promised not to do it again. If not the company and the T.M. are in the muck cart alongside the driver.
If this is strictly a one off for the driver, and the company, it might go one way. If there are multiple offences it could easily go another.
I think it is a level 4 offence, so that`ll be a possible £2,500 fine each for both driver and company.

If deliberate steps are taken to falsify records, that rises to a level 5 fine, max of £5,000 plus up to 2 years in clink.

Had my share of ‘special circumstances’ like weather/breakdowns/accidents stranding me for a lot longer than 1 minute.But if I did go over my time you can bet there was a good reason for it and it was shown on the record.

You obviously didn’t see the irony of when running bent and being a rebel meant being paid for working while sitting in a cafe or having a rest in a layby.
