Drivers Hours - Rest Periods?

A bit new to this so bear with me. Usually ok but a strange set of circumstances to me has arisen & need a bit of guidance as I think I might have infringed a rest period!

Right, here goes:

Week 1

Mon
Tues
Weds
Thurs
Fri
Sat (13.30pm finish)
Sun Rest

Week 2

Mon Rest
Tues (07.30am start)
Weds
Thurs
Fri
Sat (18.30pm finish)
Sun Rest

Week 3

Mon (07.30am start)
Tues
Weds
Thurs
Fri
Sat (13.30pm finish)
Sun Rest

Week 4

Mon (07.30am start)
Tues
Weds Rest
Thurs Rest
Fri Rest
Sat Rest
Sun Rest

I think I might be short on rest between week 3 finish & week 4 start by 3 hrs - is that correct or does the fact I was on rest week 4 after Tues compensate me in any way?

Thanks in anticipation.

Andy

Ta Rog & Hi by the way.

If thats correct then I’m ok but I would be grateful of the views of the so called experts as you put it - I am keen to learn all the little bits that I can.

I am an avid reader of this site but a new poster (my first one).

As a new class 2 driver (early Oct 08) I have learned a great deal from the message boards & instructions for gears etc on this site - so a big thumbs up from me n keep up the good work - it is very much appreciated.

Two consecutive weeks with reduced weekly rest periods, weeks 2 and 3. Not allowed

In any two consecutive weeks a driver must take either:
2 regular weekly rest periods, minimum 45 hours,
or
1 regular weekly rest period, minimum 45 hours and 1 reduced weekly rest period, between 24 and 45 hours.

Week 1: Regular weekly rest period taken, 66 hours

Week 2: Reduced weekly rest taken, 37 hours

Week 3: Reduced weekly rest period taken, 42 hours

Week 4: Regular weekly rest period taken, at least 45 hours plus compensation for 8 hour reduction in week 2.

No point compensating for the reduction in week 3 as it was an illegal rest anyway. :stuck_out_tongue:

It depends on what you were doing before Week1. If you can count the long rest at the Week1/Week2 weekend as being “in” week 2, then you’re OK. If you can’t, then you’re missing a full 48-hour rest in the Week2/Week3 fortnight.

Thats what I thought - just 3 hours short on that rest period.

It was just the compensation idea I was unsure of in that final week (well clinging to in the hope of getting me out of of a fix so to speak)

Thanks for all you time & effort to all who replied.

As a matter of interest, what will happen now I have had that illegal rest period & is it anything to worry about?

just a thought - did you have a 17 hour break at any time after the 8 hour reduction but before the next weekend

What difference would that make then? Other than him no longer having the 8 hours to compensate for?

Was I forgetting that a 45 MUST be taken and just making up the shortfall is not enough to set the rest clock to zero

Compensating for the reduction does no more than that, it doesn’t remove the requirement to have at least one regular and one reduced rest period in any two consecutive weeks.

That’s what I was referring to - I had overlooked that rule

Oh. well - time to duck…

After much maths & totting up the most break I can come up with anyway is 16.5 hours (Fri 15.00pm - Sat 07.30am)

Guess it doesn’t matter now anyway re the last reply!

As I asked before, what will happen to me now I have infringed a rest period by 3 hours.

Phew, I thought just steerin around everyone else was the hard bit en all - seriously though, I am just so annoyed with myself for getting into this position!

If it’s just a one-off then not much I would think.

I,ll join you in jail Andy :frowning: i had 96 hours fortnightly total driving down to me for not totalising my hours last week so i,m grounded till tomorrow when i am doing a Boulogne to tip wed am

Fingers crossed then!
