Drivers hours question

As far as I remember the regulations say, a driver needs to take 45 mins break, if he works for more then 9 hours, so in this case 45 mins break has already been taken.
Why need for an additional 15 mins break?

There’s more than one part to that regulation and all parts that apply should be complied with.

(2) Where a mobile worker’s working time exceeds six hours but does not exceed nine hours, the worker shall be entitled to a break lasting at least 30 minutes and interrupting that time.

(3) Where a mobile worker’s working time exceeds nine hours, the worker shall be entitled to a break lasting at least 45 minutes and interrupting that period.

u Each break may be made up of separate periods of not less than 15 minutes each.[/u]

(5) An employer shall take all reasonable steps, in keeping with the need to protect the health and safety of the mobile worker, to ensure that the limits specified above are complied with in the case of each mobile worker employed by him.

by breaking early you give yourself a chance of a 3rd driving…
spell of a decent length
if you were just driving and wanted to do 10hrs it could be 3:20 x 3

what ROG said is correct but I know a load of people who interpret it as once you have had a 45 you can more or less work until the end of your shift.

There’s only one way to interpret this surely ?

There is only one way to interpret that but there are plenty who find different, incorrect, ways to do so.

One of the favourite ways to misinterpret it, and a way that I know for a fact has been taught on a DCPC course, is that it only applies to the first 6 hours work in a shift. Completely wrong but people still believe it.

100% as above so many think they can take 45 in the first 6 hours then work right through

My drive and work mixed up a lot. My working day starts 6:30. By 12:30 I have done Either 1 15m and 1 30m or 1 45m break.

Now my question is How long i can work after 12:30. 16:30 ? 17:30 ? any more breaks towards end of the day? This is a mix of drive and other work. around 50%/50%(skip lorry)

If your 30 or 45 break ended at 1230 then you can work until 1830 until a 15 break is needed unless you need another 45 driving break before that

If your 30 or 45 break ended at 1230 then you can work until 1830 until a 15 break is needed unless you need another 45 driving break before that
