On my lonely journey from j1 m6 to livingstone i had far to much thinking time on my hands with Jeremy boring talking rubbish i decided to think about my driving hours and how in just 4 1/2 days i can use up my hours and in 5 days the week after and it has been bugging me. We are the only people in the country who are told what hours we can work and how many days we can work ( Could be wrong). It costs me £125 for the 6th day i could be working but cannot. Anyway does this not contravine the human right to work how long as he wants?
Also are digital tacho machines illegal? On a roadside check if you drive the same truck vosa can go back 1 year and do you if there is anything but if your still on analogue they can only see 28 days. Again is this not in breach of equality? And since vosa on black and white admitted that digi tacho’s are not accurate in a court surely any offence found has to be dissmissed?
I think allot of rubbish but i thought that this all makes sense?

I think you are saying that you have used up all your weekly & fortnightly driving time so cannot do more work.
If you have not used up all your WTD time, could you do some ‘OTHER WORK’ that does not come under the EU driving time regs? - van driving or something?
Thinks - hmmm… if you are doing 90 hours driving in 2 weeks that would be 45 on average each week for the WTD plus ‘OTHER WORK’ time… that would probably take you over the 48 WTD average so maybe my original idea is not so good… oh well…
To me that seems rediculous since they have co pilots and computers do all the flying. Whats happened? I could earn more cash work the extra day or 2 and i am sure most drivers would like the “option” to work more especially at this time of age? I am lucky i work 5 days and land 500 in the bank but a extra 100 quid a week wouldnt go amiss? Factory,shop, van drivers (to a degree) mp’s accountants, doctors etc can work what they want.
As for ROG yes my driving time is maxed out by day 5 each week and when i throw my 2 10’s in by day 4. I do constant driving rugby to livingstone back down back up etc.
Firstly I understand where you’re coming from and to some extent agree that in your position it a bit hard but no way does it infringe on your human rights, weather we agree with the driving limit or not the fact is that it’s regarded as a safety issue
As I understand it VOSA will not come down on you for any infringements found on the driver card that’s more than 28 days old
I imagine that if VOSA found too many indiscretions on you card that were more than 28 days old they may show more interest in the firm you work for though
So i wasn’t thinking stupid thoughts then. Why can’t our governmment ever think with sense? I do not think that safety comes into drivers hours in a way. I believe that you should be able to drive a maximum on 10 hours a day and must have 11hours off minimum. Thats it simple no confusion one rule. Oh yea but you must have a 45 every 5 hours driving and only work 6 days maximum a week. I’d imagine owner drivers and those of us like me paid by the load would rather have that rule. And as for those by the hour a bit extra in your pocket if you wish? But in all honesty at the minute for us who want to work that little more it is anything from 100 pound hrly to thousands for owner drivers getting that extra load in.
I think the WTD was the worst thing brought out. It doesn’t seem to have benefited many, if anything it is quite the opposite, just unnecessary complications and those that it may have benefited, that just meant a job sharing scheme.

what annoys me is that it says your free time can be spent doing anything so long as its not paid. So i can spend my free time putting up concrete fences but not if someone pays me £20 to do it?

If i was a single bloke god yea i’m happy but not every trucker is single. Once things pick up and jobs become available again if your in debt would it not be nice to work a extra day and use that to get out of it?

I was in the same situation as you in the late 80s and early 90s (wife & newborn) but at that time I was working for a fast growing company where a bit of ‘rule bending’ in regards to actual working time was done.
We used to take the tacho out about 15 to 30 mins after finishing the run and then work in the warehouse.
We got away with all this because we had hand written time sheets which were duly ‘lost’
It would not be unusual to do 80 to 90+ hours in one week - all paid for and those after 40 were paid at time & a half
On sundays it was truck general maintenence and I often use to take Mrs & baby with me so we could get some time together.
Full days off were when we had holidays.

In my experience - if you start working 8 days a week you will soon be single again but paying for a house and kids you never see.

Ever heard of a factory worker or anything like that getting prosecuted for working over the hours though? If it isn’t properly regulated or non regulated there could be a argument i’m calling it quits on this one. I think its made complex for a reason and thats to keep controll of us all. I shall not ever think of this again. I shall stick to my CB been left on in future ha ha.
I Think others can still opt out at present.

I was earning over £750 per week 6yrs ago’s had a nice house, and what i thought was a happy family, but i come home on a friday night to be told your never here i dont need you here anymore,lost everything mate except for seeing the kids.
So i agree with you that little extra does come in handy but your home life I think is more precious as i didnt really see my kids grow up.
As has been said spend time with the sprogs they are not young for long. Plenty time to chase the dollar later on.End of the day your decision hope you make a good one!!
