also when people are waiting to be tipped at sites and rdc’s, what mode is being used on tacho?

No that’s not correct. You can split rest every day if you want.
Whatever mode you want depending on what your doing.
cool, another question, if you do a 15 hour day and you take 12 hours off before your next shift, is that a regular or reduced daily rest? My thinking was that this is a reduced because only 9 hours fit into the 24 period in question…am i right in thinking this??

You can still have a split daily rest.
The mode when you’re waiting to tip will depend on the circumstances.
I have it in writing that so long as your keys are hung up/handed in, you are legally allowed to take a break ( providing you are on the bay long enough ) and you are not working in any shape or form. This letter which every driver received, was in fact sent to the company by VOSA.

Am I not legally allowed to take a break whenever I feel like it whether my keys are in my pocket or not then??

Your keys don’t need to be hanging anywhere for you to have a break either on a bay or off a bay.
I agree, but i think that to be 100% legal, if you have the keys, surely you are still in charge ( like drink driving ) but its only a theory of mine that others will answer with greater accuracy.
You know that on other posts, there have been reports of VOSA checking on drivers whilst in an RDC, and also waiting outside, whether true, is up to the drivers concerned to clarify.
Break can be taken when not driving or doing any other work - thats it really
To change current legislation on something like split daily rest would require the EU parliament to propose it (will be on internet) then have a general agreement to do it
We would get to hear about any proposal well in advance of it ever being made law
Being ‘in charge’ of a vehicle has nothing to do with EU driver regs
UK domestic regs are different because they state that a driver is ‘driving’ if behind the wheel which then matches up with general UK laws

So it’s just a theory of yours then? No letter from VOSA? Just another “well, I heard…” Sausage smoker!
So if taking a rest at a MSA I should hand my keys in somewhere? Surely it’s a rest if your not working regardless of your keys location… Tramping etc…

VOSA may sometimes wait outside RDCs to see if drivers are working whilst booking break, I’ve no idea if they do or not.
Whilst on break you can have your keys in the ignition, in your pocket, in your mouth, or hanging up in the transport office, it makes not one bit of difference.
