I would say so yes. this is because although they might say they’re not driving and have no intention to I ask if you were a bad driver n well crashed or what ever would he then swap places and drive back to the yard??
if he doesn’t put his card in though in slot 2 you wont get done for it as its his responsibility, just like him choosing if to wear a seatbelt or not

No, I used to do company, pre employment, agency assessments and was told by head of compliance no need as tacho reverts to poa but you’re in fact working as you’re assessing so do manual entries after.
No, They don’t where I work. As drivers if we are sat in the passenger seat our day is recorded by manual entries at the end of the day

If you were a bad driver and the trainer had to drive back, they would put their card in slot one, and hopefully shove yours (as in the driver so bad they had to be removed) straight up your jacksie!
Besides in slot 2, while the driver is driving, the Tacho will record POA for slot 2, the assessor is not on POA, he is working, because he is “training” you!
sorry but I disagree. if you had a 2 guys double driving then only 1 has to put there card in and if they get stopped say its ok he’s on a driving assessment and I’m the trainer. if they don’t get stopped switch drivers than repeat?

That excuse would only stack up within a 4 hour radius of the yard. Any further out and it would flag up like a firework. And with the rules on double manned teams allowing constant swap overs, where would be the advantage in keep pulling the card? And how do you explain only 4.5 hours rest if you get a tug on your second stint?

You can disagree as much as you like, you are still wrong. If the tacho cannot accurately record your activities, you don’t need to use it. Simple.

Not even if the assessor/trainer does some of the driving. As already mentioned, if the trainer puts his card in Slot 2, it will record all the time the vehicle is moving as POA when in fact he is working. If I was doing the assessing/training I would leave my card out. If I actually swapped over to the driving seat I would put my card in at that point and use the manual entry facility to correctly record Other Work and Breaks for the earlier part of the shift.
