Driver sentenced to life

I always thought you had to “get up that morning intending to kill” for it to be “murder”?

It doesn’t matter what time you decide to kill someone. You could mull it over at breakfast if you like. You could decide over a spot of lunch. You could lose all sense of reason and self control in a split second and drive over someone’s head because he threw coins at your lorry.

You don’t have to roll out of bed with murderous thoughts in your head to become a murderer.

You do to get a convicted for first degree murder though (usually)

If Slater had ran him down while the victim was trying to get away then yes he deserves murder but the victim was out his van, stood in front of the truck probably goading him on or trying to get him to come out and ‘‘sort it out’’ ! He contributed to his own death unfortunately so IMO manslaughter would have been far more appropriate for the crime.

Jesus, what a ridiculous comment! As has been pointed out already Murder is tried under common law, don’t watch American TV so much. There is no self defence here or any mitigation at all, the bloke killed someone, a father, a husband no matter what the provocation. We don’t need idiots like that in this profession, heaven knows there are enough muppets already who bleat on about how LGV drivers are down trodden quickly enough but still drive aggressively and portray a less than professional image. This guy deserves at least 15 years and be stripped of his C category for ever.
Rant over.

First post, with a lot of sense, well said mate! (and welcome to Trucknet)
With intelligent comments like that you could find yourself in a minority here if that is to be a typical post from you.

Why was the victim standing in front of the truck?

LeedsChris:
Just out of curiosity, does anyone know what started the cat and mouse incident on the road, and did anyone know the deceased and what type of character he was.Good or bad, without speaking speaking ill of the dead mind.

I knew the victim when he drove for Hays logistics on the Scottish Courage contract. He did a long stint in the office at what is now K & N at Normanton when the place first opened before returning to driving out of Trafford park or Royal brewery, I don’t recall which. He was a popular polite bloke and didn’t seem to have a bad bone in his body, not often you can say nice things about people who work in traffic offices but none of the drivers disliked him.

Why was the victim standing in front of the truck?

That is totally irrelevant, the guy drove the truck at him intending to cause him serious injury or death, ergo murder.

Definitely murder, no excuses.

But, if the deceased had just kept driving he’d still be here today. Too many people wanting to pick fights on the road.
