I woke up with a bone this morning. I’m worried I may have broken the law. Advice please.

The actual wording of the law is for “use of a mobile device whilst driving”. And since I didnt use it,I didnt break the law.
Some might argue even touching it is classed as using it,but since the onus is on the prosecution to prove said use and I dont class moving it to stop it becoming trapped under foot pedals as being used,I wanted to fight it and argue my case in court because I dont believe I actually broke the law. Its not like in claiming it was exceptional circumstances for using a phone while driving. I didnt use it. Therefor fighting it is not classed as wanting an exception.
Theres a difference between arguing your case and trying to wriggle out of it when your caught bang to rights
But the point is,I learned my lesson and my phone is now left in the boot or the back seat before I get in the drivers seat. I dont want any more points SO I LEARNED. If someone is so ■■■■■■■ stupid they rack up 10 points without learning their lesson then I dont think they deserve to claim hardship and exceptional circumstances if there is a family emergency and they get caught speeding. If they’ve got 6 points already and STILL didnt say to themselves “here,I might need to calm things down a bit and watch what im doing” then they dont belong on the road. If they have 10 then get caught speeding during a “family emergency” then they still deserve the ban.

Fair points Snowman, but what i was saying orignally was that some circumstances do need “exceptions”.
Not specifically the guy in the OP, where you claimed NO exceptions but in many other scenarios
You have proved my point by feeling that your circumstances were exceptional and you should not be penalised for the “offence”.
As it happens I agree with you regarding simply moving a phone/device/packet of sweets etc etc, from somewhere they may cause a problem to somewhere safer…but as you said “no exceptions”
The law needs to be applied with a modicum of common sense, recognising that different circumstances require different actions, that is where exceptions creep in. in your case a quiet “don’t do it again” would have probably sufficed.
Guess we have both argued our points fully now, nice to have a discussion without bad feelings :slight_smile:

I’m in two minds with this. When i was young got a load of points ended up on the brink of a ban and just calmed down with stupid driving and speed because didn’t want to loose my license. Generally now i don’t speed. A lot of it is impatience and doesn’t get you there any faster. The road from my house to the bypass is about 2 miles and big wide open road used to be a 40mph now dropped to 30mph for no real reason. I sit at 30mph on it even at 3am because difference in time is seconds compared to speeding and its not worth the risk, because its like shooting fish in a barrel police tend to sit there espec middle of the night. So is really no excuse for screwing the nut and slowing down espec if your job depends on it.

But other side of it is, when i passed my test in 1991 was totally different higher speed limits and no scameras if you had a load of points back then prob where hammering it everywhere these days espec in England big wide open roads speed limits dropped and scameras everywhere quite easy to find yourself with a load of points where as years ago would have a clean licence. Same with insurance companies so many people with points its not that important anymore and prob why courts are so lenient with people with 12 points at times.

Im sorry, but giving these people more points on the licence, or banning them will make absolutely no difference to them what so ever. They don’t care and will continue to drive no matter what is said or done to them, right up to the point where the muppet will kill a child as he drives like a maniac at 109mph through yet another 50mph area. The bans and the points have made no difference in the past and I don’t see that they will make any difference now. Lock the idiot up!!!
