Driver conduct hearings - phone use

So a friend of mine was reported to his previous employer for using his phone to text whilst in a private area doin less than 5 mph
He resigned before he was sacked but the company obviously miffed by that reported him to the tc…now he has a hearing but hasn’t had any points etc

Anyone experience this? Likely to get a Ban?

Why would an employer about to bollock someone be miffed if they decided to resign instead?

Many yards find it real hard to get rid of someone - even when bang to rights - especially when there’s a Union to get past.

It always seemed daft to me that Smoking got banned in cabs - but taking a phone in there was not…

If you require a phone in your cab for more smooth running of your job - surely the firm should supply a hands-free which can only be used by YOU to phone the OFFICE and other important work-related numbers when it’s appropriate…

If you let people in there with their own fancy phones - they’re going to use them. Even if it’s OOh a beep - wonder who’s texted me?

On my route today, I’ve had a kid run over in front of me, a wheelbarrow left in the slow lane of the M6 to dodge around, and a slow-moving reality trailer on the M25 16-15 being escorted by VOSA, and followed closely by a fire engine! It didn’t look as if his wagon was about to burst into flames…

Too many people standing around holding their phones up for selfies and filming of what can only be the macabre kind.
At least the young lad wasn’t killed - but WTF was he doing trying to dash across a dual carriageway on a downhill stretch FFS? :open_mouth:

Why would the TC even get involved? It’s the word of one private individual against another and as there’s been no criminal conviction there’s no way of proving beyond doubt this happened. If I were a TC and an operator came running to me telling tales like this I’d be more interested in the mindset if who is running the company and if they’re mentally capable of doing so. Of course your friend could just be pulling your chain.

If it was on a public road then sure, drag his backside from of the TC but on private land? Seems like a waste of everyone’s time.

In a place of work, its the against the law to smoke. I guess the cab is considered a place of work.

I have no idea what will happen, though i hope the sneaky swine putting the boot into your mate by reporting him (like a good little drone, khmer rouge/stazi/yewtree would pat him on the head) after he’s already resigned, gets a dose of the pox and never gets another shag.

What in heaven is the obsession with these bloody electronic devices, you see half wits everywhere with their square eyes glued to the damned things, bloody addicted, can’t even pee at a MSA urinal without some twerp texting at the next one while presumably peeing, you fall over the buggers as they amble aimlessly lost in their virtual world…are they all spooks or james bonds like those with the bloo tooth rivetted to their shell likes, will the taliban or IS destroy civilisation if they didn’t read forward or send that vital message before shaking the drops off.

What the hell is the matter with people, get a real life not a virtual bugger…

When did he resign,I at a previous job was meant to go too a disiplinarys hearing for putting a contract in jeopardy ,a big boss was comming down for it ,hundreds of miles away .
I rang up a hour before time of disiplinarys meeting and told them I wasn’t comming ,leaving there and then ,and had got another job .
They did there nut saying I had too attend ,big boss had travelled hundreds of miles ,why had not given them reasonable notice .
It ended with my depot boss saying he would make sure I never got a job in that area .
New job I had,boss couldn’t care less,said if you do the job you’ll be ok,if you zb about I’ll just kick you out the door ,no warnings,disiplinarys etc ,had a few ear bendings off him but we got on ok,should never off left .
Could that be the issue herewound them up by resigning with no notice ,now there trying to be vindictive .

The letter from tc came about 2 months after, there was cctv evidence of the phone being used whilst moving but he’s not sure if the company are allowed to show it to tc

is there any proof he was on his phone?? ie plod or vosa or a camera see this■■? if no then ask what are you on about. ask who has accused you. when they say so n so you say you mean my old boss who has it in for me■■? then laugh :laughing: :laughing:

edit ok so its on camera. I would ask to see this footage before you see them as im sure its your right. I maybe wrong as I have never been to a TC hearing before only magistrates and crown courts. I never admit anything until im presented with the evidence that can be used to convict me.

Yep agree with war1974. The use of mobiles on a Public Highway is prohibited. You can still drive round a private yard doing what you want. It may be against company rules but the TC would have no jurisdiction.

What about bus stations, still technically private

The OP said it was “a private area”, I believe a road on private land that’s open for public access is regarded as a public road as far as the law is concerned.

It would be interesting to know what the OP meant by “a private place”, I suspect it’s a road that’s open to the public which means there was an offence committed after-all…

Supermarket car park is one example of private land where the Road Traffic Act still applies that that instantly comes to mind. Basically anywhere where the public has unrestricted access.

Ok,so your pal goes I front of the tc and tells them that he was asked to use his phone whilst driving IN A CONTROLLED AREA as part of a safety video for his place of work to highlight the dangers of using a mobile whilst driving…then his employer decides he wants to get rid if your pal so threatens him with said cctv footage to force him to resign.

Leaving you pal out of a job because his employer tricked him into helping with the “safety video” the employer asked him to take part in.

End of story,no more questions your honour…next stop employment tribunal :smiley:
