Really? I always though the offence was the use of a handheld device, that’s how they managed to prosecute drivers who take pictures and videos as they pass accident scenes. Unless they used the catch all “driving without due care”.
Not sure which is more serious.

So did I but it was posted on here recently and it seems the transmission of data is the thing. No doubt someone will find the post. It also pointed out that under the law you could change music on Spotify that was downloaded but not streamed music. I do love the little foibles of the law!
to be correctly prosecuted for mobile phone use,then they have to prove you were transmitting or receiving data.
mostly they charge for phone use as your average plod plank dont know the rulesand mostly folk dont know how to contest it hence easy fixed penalty pickings.
i.e get dont for mobile use.prove at the time you were videoing or recording voice ect with no data use.case dropped,and you wouldnt be done for without due care ect so long after the event,.
obviously that happens if you can be bothered proving your not guilty aspect with a day in court instead of the fixed penalty.

Hmm, kind of like not being allowed to beat or shake a mat in the street after 8am.
That transmission of data thing does sound familiar now I come to think of it. But like I said, they’ll just use a catch all offence instead.
