Drink driving charges in a cherry picker

Two young lads who are builders have lost their licences for 22 months each for being drunk in charge of a cherry picker crane, they got in it, and raised it, but the paper did not say if the machine went on the public road or not, your thoughts on this, for me, it is only a prank after one too many ?
What next, the whole of the student population getting jail for wearing traffic cones on their heads, and climbing the city centers Christmas tree ?
Is the cherry picker classed as a motor vehicle, if so , where is the number plate, and insurance for road use, or a MOT ?

you can be drunk in charge of anything if youre posing a danger to other people… off road or on.

Early 70’s when there were still London docks my brother an me found a couple of those little electric trucks they used and went for a ride around till we got stopped by the dock police and we were well 3 sheets to the wind, happy days :slight_smile:

Raymundo, you could have crashed and fallen in to the water, did you sign the risk assessment pages, wear a life jacket and a hiviz, but craic on, it sounds like fun to me.
In the days of when parking was allowed in Portsmouth docks, when there were no ferries running, I would partake in jogging or cycling around the lorry park, two dudes in suits said to me, it is not permitted due to health and safety.

I’d be curious to see what category cherry pickers come under on your licence; I presume they do, otherwise the authorities wouldn’t have been able to suspend it, surely? I would have thought to be DUI you would need to be in a public place, at least, and be in charge of a vehicle that requires a licence.

Any proof this really happened or is it just one of those I heard things,just saying like!!

“drunken city centre rampage” puts a different, though maybe sensationalist slant to the plot. Also, took a long time for them to be caught (driving from 12th to 24th apparently). Quick conviction though. Still doesn’t say if they were on the road though.

In Austria you just need Anti Social Behaviour to loos it
Drunk on Horse or Bicycle you loos it
Drunk using Public Places or Road in a dangerous Manner. (You unfit to hold a License as you are not Trustworthy :exclamation: )
Sentenced by Court (Shop lifting or fighting or what) and loos it
arguing with a Policeman could easily result as judged by him “unfit to hold a License”

If it’s a mechanically propelled vehicle on a road or public place, the rules apply

Worth noting that a “mechanically propelled vehicle” is not, legally speaking, the same as a “motor vehicle” (although the latter are pretty much by definition included in the former).

over in crime free Canada the mounties caught and charged an auld boy for being drunk in charge o a Zamboni)(machine that cleans the ice at ice rinks) during halftime at a localish hockey match, seems he was bouncing of the sides lol.

What’s ironic is he’s posting lots of pish on here, because he’s lost his licence!

They were both handed a 12-month community order, banned from driving for
22 months and told to pay £145 each in fines.

I can understand the community order and the fine but why a 22 month ban, it was a prank for Christ sake, a very stupid one but a prank nevertheless, if they had to be banned why make it more than the mandatory 12 months.

Thank you for that, definitely over the top sentence,two blokes just having a laugh,no sense of humour now is there.

I agree that the ban is too long. The rest, along with a 12 month ban is more than enough to tell these young lads that it wasn’t a good idea and reckless. But the extra 10 months driving ban is just pushing them in the wrong direction, and not at going to help them get their lives back together…

I’d be curious to see what category cherry pickers come under on your licence;

Class B licence would in theory allows you to drive plant on or beside a live road or vehicle accessible area as that came up in my cherry picker and dumper truck tests. You would need insurance and such however to drive on a live road (not too sure about pedestrian areas). I can’t say for sure, but pretty sure if you’re caught riding a bike under the influence it can affect your driving licence, odd as it might be.

As for the sentence - I suspect that was because they “stole” the vehicle in question and were driving without insurance etc. on top of the drink driving offence.

No elf an safety around then Tobes and fell in the oggin quite often as well but them electric carts were good fun. Only about four foot wide and about ten feet long with one foot pedal you pressed down to release the brakes and a lever to steer by while standing at the front with yer back to the load platform. Jogging or cycling would be too much like work !!
