Downloading digicards

 heyup lads, i,ve been doing a bit of agency driving lately, and when you get back to the yard, i ask about downloading my card, and i get the,“oh dont worry about that,?”, “oh we,ll get it next time youre in ?”, oh we,ll catch up with you, ?".
well ? who is actually responsible, and what would happen to the said person if i lost my card, ?
i wouldnt be suprised if the answer is ME  . :open_mouth:

whats the commonest thing a driver carries, ?
the blame : :unamused: :unamused:

hi mate best thing for you to do is ask then to give you a letter to the fact you ask for them to download your card, or tell your agency that you are having this problem and ask them for a letter you can carry so the can sign to say there are aware of your request to download it

you are doing the right thing by asking them to download it, but if there can not be bothered then this will back you up if there come looking for the data and blame you for not asking them to download it

hope this helps

Don’t worry your head about this one. You have made the card available for the Transport Undertaking (posh phrase to describe the Operator under whose orders you were working) to download the card. They didn’t for whatever reason - not your problem. They commit the offence of ‘failing to download a driver card within the relevant period,’ which is within 28 days.

If you ‘loose’ the card that’s your fault but it isn’t an offence provided you report it within 7 calendar days to DVLA. They will charge you £ 19 for a new one, which will have to be collected from either a VOSA Test Station or your local DVLA office. If you ‘find’ your ‘lost’ card then it must be returned to DVLA, it is an offence for a driver to be in possession of two valid cards.

 right then, so i need a written type of disclaimer so if they dont download, i can just say sign this,■■?
thanks for that, i wasnt bothered about the cost of replacing the card, just that would i be liable for the information on it,
so these cards arent what they were quoted to be then are they ?

Hi mate you don’t need one its just my opinion

You dont need to worry … All your info is in the unit’s head ( memory on the truck’s tacho) your really only carryingon the card your 28 pos more tachos /working days when using a card.
The company you worked for will just down load the info from the tacho head .

No letter required
no printouts required
no offence commited

Just drive and smile :grimacing: :grimacing: :grimacing: :grimacing:

And in only doing that they are committing an offence, they are legally required to download the card.
