Hi
My hours are 23.00-06.00 sunday night
22.00-06.00mon-thursday night.
I have worked the last 2 friday nights as overtime.Starting at 17.00 and finishing around 04.am saturday
This will make my weekly rest 43 hours for the 2 weeks.
So will i have to make the 4 hours up next weekend or because i have 16 hours between weekly shifts this 4 hors has already been made up?
I hope i have explained it ok?
Thanks tonyb
Sorry to tell you this m8 but there’s not much point in compensating for both reduced weekly rest periods as one of you’re reduced weekly rests is already illegal.
You can’t legally work two consecutive weeks without a full 45 hour weekly rest period in at least one of those weeks.
Page 18:
In any two consecutive ‘fixed’ weeks a driver must take at least:
- two regular weekly rests; or
- one regular weekly rest and one reduced weekly rest.
But apart from that for what it’s worth you have paid back the compensation for both reduced weekly rest periods.
Looking on the bright side, I’ve never heard of anyone being executed for running 2 hours short on the weekly rest period
edit: If you could start 2 hours later on Monday morning (01:00) then this would be a full weekly rest period so you should then be legal and all compensation would have been paid, if that’s possible for you to do
Thanks tachograph.i can’t start later as i’m on a fixed start time.
abaut i’m sure ive read somewhere that reduced rest can be added on to a longer daily rest period.
The laws just keep changing.
I thought i was quite up on the regulations but obviosly not.
Cheers

You’re right the reduced rest can be added onto a daily rest period.
The reduced rest can be added onto any rest period of 9 hours or more by the end of the third week, following the week in which the reduced weekly rest was taken.
But legally you still can’t have two consecutive weeks without a full 45 hour weekly rest period I’m afraid, so that’s where you run foul of the regulations
In other words, assuming that you’re only having one weekly rest period every week then legally you can only have a reduced weekly rest every second week.
