I have to fuel the unit every time and wash it and the lazy polish ■■■■■■■ (who is on 5K a year more) does not even clean the inside … if that makes your answers any easier!

Have a quiet word in his ear and see if that does anything to stop him if not grass him up.
If your employer comes to the same conclusion as you and has a reasonably burden of proof they could sack the pair of you and it would be considered fair in the eyes of a tribunal.
An employer doesn’t have to prove “beyond reasonable doubt”, only “on the balance of probability” so if they could prove diesel was going missing they could sack the pair of you and win at any tribunal.
Like baldbloke says, have a quiet word and if that comes to zero speak to your boss.

Personally I’d go straight to the gaffer and tell him/her your suspicions.
What if you have a word with the driver and he covers his arse by going to the gaffer and says he thinks you’re stealing fuel. It’ll be too late by the time you have your say.
I doubt they’ll sack you if you’re being 100% honest. They’ll probably start looking at your MPG figures compared to his and if something is a miss then that’s for them to deal with not you.
It’s a tricky one but you have to look after no1; yourself.
Is he stealing fuel or is he just not brimming the tank? On Friday I did a run to Radlett in a wagon and got back and the gauge was still above 3/4. Did the same run last night and it was just on 1/2 tank. Had a suspicion the second wagon day driver just shoved the nozzle right in the tank and filled it til it clicked so I did the same and surprise surprise, 160L of fuel, within a few litres of what I’d used on Friday in the other wagon which had been brimmed. You can get another 30-40 litres in if you put just the end of the nozzle in wedged under the rim of the tank filler neck.
Filling a tank to the brink is dangerous, only something an agency driver would think of.

. No it doesn’t if your cap fits properly
Start a little rumour and see if he takes the bait
Heard a little whisper,its rumoured than the Company is going to be having a colour additive put in the fuel and going to do random checks because they think fuel is being pinched.
See if your fuel use shows any different,it might prove your suspicions
And I have never had a problem with diesel leaking onto the road from the cap either, most have ant syphon devices fitted these days anyway, i will usually always brim it when fuelling especially if it’s a poxy small tank and most caps have a seal these days

This might have done in the bad old days of transport, but not now. We have tanks with properly fitting caps, as long the neck isn’t damaged, nor the cap, you can fill it up.
This will kill no motorcyclists.

They couldn’t sack two people fairly just on the basis that fuel had in fact gone missing - it is common sense that the fact of missing fuel doesn’t (without more) make it more probable than not that both men are stealing it. In fact, missing fuel doesn’t prove that either man, or any particular man, is likely to be the culprit.
The employer would be expected to collect more evidence first.
It is irrelevant that the driver is Polish and that he is on five grand a year more than you, the fact that you wish to point these things out may speak volumes about your question and your prejudices.
If you can fuel it up when you start and when you finish and keep a record of how much you put in and km covered and the odometer readings. Don’t forget to keep smarting over his extra 5 grand !

You ever look in a supermarket and see that the same people are always on the same couple of tills? This isn’t an accident. It is deliberate so they can monitor any possible cash loss. If your on a till and money goes missing you can’t relax just because you havn’t taken it. Once they can narrow it to 2 or 3 people if they can’t be sure they would (and have in the past) sack them all. Usually in that situation the guilty one owns up. Nowadays all the tills have permanent cameras on them so theft from a till is tricky to get away with but you get my point. As mentioned employers only need probability not beyond reasonable doubt. If fuel is going it has to be 1 of the 2 so to sack both would be viewed as fair, especially if it resolved the problem when they were replaced.
Regards the question posed by OP have a word with the boss and tell him your “concerned” about the fuel use and leave it with him. What he chooses to do after that is up to him. Maybe the guy is on the take or maybe as said he can’t be bothered to fill the tank. Either way the boss can look into it and you have given yourself some valuable protection if anything comes of it and you get dragged in.
We have a few Polish. They dont fill up full.They put the Nozzle in,switch Ignition on and when Needle is on Full they stop the Fuel Pump. So it looks to the Office as if they use less Fuel then the other Driver.
There’s a famous case with William Hill, the bookmakers. £10k went missing from the safe and 3 people had access to the safe. William Hill sacked all 3 and eventually won at tribunal when they were challenged. It set a famous precedent and that’s why "beyond reasonable doubt’ is used in courts of law but ’ on the balance of probability’ for employment matters.
No it’s not fair but it’s true pm yes they could sack 2 people for the same thing.
We’ve got night men who don’t fuel, ad blue or wash the thing. Don’t automatically think they are on thieve! Kinda a serious accusation yer throwing about
Bit we have anti syphon and telematics and it’s quite rare to fill outside of the yard. So never really an issue of fuel theft with us.
Tell your gaffer in the morning it’s not fueled up, keep telling him… drop in lines like this ridiculous not fueling up for the next driver it’s commen courtesy. If it still continues after a week and your gaffer ain’t confronted the guy then you stop filling aswell soon come to a head if that happens.
It’s pretty easy to work out fuel theft if it’s the same runs night in and night out.
