If you are currently facing prosecution on a charge of speeding where the camera involved was a GATSO (i.e a rear-facing camera), I am going to be posting an article which explains how you can have the Notice of Intended Prosecution withdrawn just by writing one letter.
I expect to be posting this within the next fortnight with a template of the letter you need to write.
Although I do not habitually speed, I have used this letter before, with a 100% success rate. I anticipate the same result this time and am just awaiting Thames Valley Police’s letter, which I expect to receive soon. This is an entirely legal defence which is only available to the drivers of heavy goods vehicles. Then I will scan and post the correspondence.
If you have received a NIP, don’t send it back yet. If you have been fined and received penalty points, it is possible that you could have them removed and get your money back exploiting the same loophole- a loophole so large that you could drive an articulated lorry through it.

This is interesting Harry. I got done in court 4 weeks ago for speeding. It only went to court cos I never received the NIP. So any help in getting my money back (it was a lot of beer tokens) would be appreciated.

I’m not entirely sure about the morality of it Rog, but the simple fact is that the Police have to follow their own guidelines.
I just don’t want to hand over £60 of beer vouchers and lose my clean driving licence, because it will cost me more to insure my car. And I know how not to.

Because speed camera’s of the GATSO type are generally nothing more than revenue earners for local authorities, because many of the speed limits are unnecessarily low (don’t know where Harry got court though), because he can

Because, from what it sounds like, if the letter of the law has not been followed then the speeding charge cannot be proven, therefore prosecution is invalid.
And also we need every chance we can get these days.

No, I am saying that the Police have to follow ACPO guidelines when persuing a speeding conviction. Same as us, they have to follow the rules

But if some of those numpties are unsafe at any speed and if we take that argument to it’s logical conclusion we’ll have to bring back the man with a flag walking in front for everyone but at that time there were’nt enough drivers using mechanically propelled vehicles to even sort out wether some of them were numpties or not it was something to do with frightening the horses? but a train flying along the track did’nt seem to worry the horses when it suited them waiting at a level crossing.
I will post the letters written when I receive the next one, but I will say that I was flashed on the eastbound A44 at Chipping Norton, travelling at 36mph in a 30 mph zone.
My defence has nothing to do with the recently lowered speed limit at that camera site.

The answer is probably no, it is wrong and they should not get away with it.

30mph +10% is 33mph + 2 = 35mph.
