I was on the understanding that if you did 9hrs driving you can extend it to 10hrs twice a week what are the rules for working nights (perm) as ive been told I can extend it more than twice if needed as the company wasn’t tighted into it is this right ■■?
Days, nights, irrelevant - same rules apply…2 x 10 hour extensions of driving time per week only.
I’m guessing the company in question has a workforce or collective agreement in place to ‘opt out’ of the 10 hour maximum shift time (driving & other work) as required by the RT WTD. Meaning you can extend your night shifts beyond 10 hours in length if the opt-out is in place. Of course only 10 hours of the extended night shift(max. twice per week) can be driving time.
so you can do a mixture of driving and other work up to 15 hrs but 10 hours driving max twice a week
Correct - providing the ‘opt out’ is in place… although 15 hours includes rest/breaks and any period of availability (POA). And can only be done as a duty 3 x per week to enable regular daily rests to be taken.
If no opt - out in place then shift time (excluding breaks & POA’s) is limited to 10 hours maximum. I.E. 6 hours driving plus 4 hours other work = max.10 hours, regardless of any breaks & POA, so you could be at work longer than 10 hours, say if you had 1 hour break plus 2 hours on POA = 13 hours.
BUT an overall shift time of 13/15 hours must be observed depending if reduced daily rest available - which of course includes breaks & POA’s!!!

The daily/weekly driving periods for nights are exactly the same as days.
You can drive up-to 9 hours between daily rest periods, this can be extended up-to 10 hours twice a week.
Assuming you have an opt out agreement in place:
You must have a daily rest period of at-least 11 hours completed within the period of 24 hours from the start of the shift, this can be reduced to no less than 9 hours three times between weekly rest periods.
If you don’t have an opt out agreement in place:
If you do any work between 00:00 and 04:00 (01:00 to 05:00 for PSC drivers) you’re legally restricted to 10 hours working time in each 24 hour period, working time does not include breaks or POA.

You can have reduced daily rest periods three times between weekly rest periods not three times per week
