Im picking brains again if thats ok? I am working a 45hr week driving an 18T curtainsider. Mon to Fri 0600-1530. I am about to sit my class 1 and im very reluctant to give up my full time job to get class 1 experience through an agency.
Can I work for an agency at the weekends? I think I will be over hours? I think I know the answer and might end up having to bite the bullet!
Cheers
Paul
Every other weekend you could do a Saturday if you still have the driving and working hours available

You could do one shift on alternate weeks but whether or not you could do it every second week would depend on what shifts you were able to get and how much you had to reduce your weekly rest periods.

but if he is doing 45 hrs in his full time job then he can only do another 3 hrs to comply with wtd

No that’s not correct, the RT(WT)R requires that you don’t work over 48 hours per week averaged over the reference period.
I’m not sure if the 45 hour week that the op says he works is a typo or not as that would only leave him a daily break of 30 minutes each day but anyway I imagine that if his time did get too close to the 48 hour he could find a way to rectify the situation.
Constructive use of POA and breaks can work wonders with your working time
Can I ask a question? If I start work at say 07:30. Park up at 20:00 and have 9 hours rest so start again at 05:00. can this new shift last 15 hours or is it just a normal 13 hours?

Yes a 15 hour spread-over after a reduced daily rest period is legal.

if you had 9 off it would be one of you 3 a week reductions, so if you had a reduction shift left then yes you could do a 15 hour shift. just becareful you don’t exceed 10 hours driving before 0730 as you can only do 10 hours in a 24 hour period.

I’ve no idea where you get your information but that’s completely wrong, assuming that you’re driving to EU regulations you can drive 9 hours between daily rest periods and this can be extended to 10 hours driving between daily rest periods twice a week.
The 10 hours driving in 24 hours is only for the domestic regulations.
Your right i have always worked to the rule of driving time in a 24 hour period, don’t know why just what i was taught when i first started driving 10 years ago. its true what they say you learn something new everyday. thanks!

The “rule” in red could also mean the RTD night working regulation without an opt out

I get paid for my breaks. I included them in my 45 hr week.

Breaks don’t count as working time for the RT(WT)R regardless of whether you get paid for them or not and therefore don’t count towards the average 48 hour week

That would really be 10 hours working time rather than 10 hours driving time, though I suppose 10 hours would be the maximum you could drive if you didn’t record any other work.
Anyway the shift in question was from 07:30 to 20:00 and then start the next shift at 05:00 so the night time working limit isn’t really an issue
Cheers for your help everyone. Just a quick one about split breaks. I started at 08:00 and had a 3 hour 30 break between 09:18 and 12:48. Am I right or wrong thinking I can work up untill 20:00 and then have a 9 hour break untill 05:00 and drive rest of way home?
I dont have any 15 hour stints left if that makes a difference?

I assume that by “3 hour 30 break” you mean you had a 3 hour 30 minute rest period, assuming you have the driving time available and have the required breaks you can continue until 23:00 then have a 9 hour rest period if you wish and it will not count as a reduced daily rest periods.
The short answer is “yes you can do that”
