Well neither of them are doing anything illegal if thatâs what you mean.
You should have a break of at-least 15 minutes before exceeding 6 hours working time (working time = âother workâ + âdriving timeâ).
If youâve done some driving this 15 minute break can also count as the first part of a split driving break, so you would need to take another 30 minute break before exceeding 4.5 hours driving time, or another 15 minute break before reaching another 6 hours working time whichever came first.
I donât see why itâs a daft question though
Either you know the answer or you donât, and if you donât you ask people who do, nothing daft about it really

Perhaps I could have explained it better but what Iâve said would still be legal as long as breaks totalling 45 minutes were taken for a shift of over 9 hours working time.
Forgetting about driving breaks, 6 hours working time then a 15 minute break, another 6 hours working time then another 15 minute break, then another 15 minute break to be completed before finishing the shift but not at the immediate finish of the shift is perfectly legal.
Depending on the total length of the working time and not taking driving breaks into consideration, thereâs nothing illegal about having only 30 minutes break/breaks in 12 hours working time.
I should have made it clear that if the total working time is more than 6 hours but not more than 9 hours a total of 30 minutes break should be taken.
If the total working time is more than 9 hours a total of 45 minutes break/breaks should be taken.
These breaks can be taken is separate parts of no less than 15 minutes each.
Iâve no idea where the â8th hrâ comes into the equation

I just had to make you think for a change
Working between 6 and 9 hours per day requires breaks totalling 30 minutes. If more that 9 hours is worked then breaks must total 45 minutes. Breaks must be of at least 15 minutes duration

Yes but if the total working time is more than 9 hours the 30 minute break/breaks do not have to be taken before the 9 hour point if thatâs what youâre going to say
If the total working time is more than 9 hours the total of 45 minutes break/breaks can be taken at any point in the shift as long as at no time youâre working time does not exceed 6 hours without a break of at-least 15 minutes, and as long as the break/breaks are not taken at the immediate start or finish of the shift.

Wdsor Be superkings
on that note hope you had a good Christmas fella and all the best for this year
When I was on Multidrop, I would have 15 after 6 hours of work, then 30 mins after 4.5 hours driving. Often, I would/could finish the day without doing 4.5 hours driving, so would have the 30 mins before clocking off. I was paid 10hours minimum per day anyway. Rarely did 10 hours though. Usually starting at 7, and finishing by 3 or 4 pm.
