Constructive dismissel?

I put a grievence in against a supervisor for victimization on the 8th april 2009 this supervisor was making nasty comments about my children and family as well as making threats to put me out of a job in minutes as her husband is a manager and father in law is 2nd in charge of the whole company.
I put my grievence in as i has a witness to the things she was saying ( a supervisor) this supervisor was prepered to talk to human resources about what she heard. Hr completed their investigation and didnt even ask to speak to my witness. Since then she and another supervisor have said hes messed with the wrong peolple and he will be out of a job again i have witnesses which were called.
I won my grievence and thought that was the end of it. I returned from holiday last week and recieved a phone call saying the supervisor has counter grievenced me as she has evidence ive used my mobile phone whilst driving in april i was therefore suspended for falsifying information to get a collegue to face disciplinery action. The only thing i handed in was a grievence which i won!!
I had a call telling me today they have me on 2 counts of gross misconduct for using my phone in april and i have a choice be made redundant or get the sack. I took redundancy and im waiting for my letter to come through the post. can this be handled this way? ive requested my grievence notes in writing from hr and have been ignored for the past 5 weeks i feel ive been forced out my job do i have a case ■■?

It seems the odds were stacked against you at that employer…

As for a Tribunal case, my best advice is that you really need to speak to a solicitor who specialises in Employment law without delay.
There is usually a 3-month (from dismissal) time limit for bringing a case, but the overall procedure possibly isn’t quite as straightforward as it used to be.
Although a person can represent themselves at an Employment Tribunal, the application form needs to be completed properly and the wording of the complaint part of the form is very important too, hence my suggestion thast you take proper advice.

You should have asked for proof regarding the allegation you were using your phone whilst driving :open_mouth:

It doesn’t matter anymore, they don’t want you to work for them, I doubt you want to work for them either. Take them for unfair dismissal at least
