Connor help needed / contract

Bluey Circles:

dozy:
This contract was issued too me in February 2009
This sentence is what I’m after your thoughts on
If employed on a five shift week basis , currently your guaranteed hours will be 50 hours within the five working days ,with a minimum of 8 hrs guaranteed per day ,excluding half - hour meal break deducted for each shift worked in excess of 4 hrs .
Now my reading of that is I’m guaranteed 8 hrs per day / 50 hrs per week  , or is there interpretation of it correct that it doesn’t guarantee me 8 hrs per day , just 50 hrs per week
thanks Connor,

was this contract written by “Immigrant’s” lawyer brother ?
Wrote 7 years ago with the wording “currently your guaranteed” “your”? did they mean “you’re”? terrible grammar for a contract but does it imply hours can be expected to change?
“guaranteed hours will be 50 hours within the five working days ,with a minimum of 8 hrs guaranteed per day ,excluding half”
apart from the weird “excluding half” tagged onto the end I would have thought that this means you will get a minimum of 50 hours Mon to Fri and if you were to do 4 x 12 hour shifts, they can’t get you to come in on the fifth day for only 2 hours to make it up to 50, they would either have to pay you for 50, or get you to come in for 8 and pay you 56.
“excluding half - hour meal break deducted for each shift worked in excess of 4 hrs” Is the “excluding half” supposed to apply in this part of the sentence ? This is so badly written it could mean anything.

I would have thought how you have been paid / employed to date will form more of a legally binding contract than that badly written mumbo jumbo. You need to take legal advice.

I would say it has been paraphrased by dozy rather than directly quoted mate.

the nodding donkey:
And giving ALL the details. It’s slowly becoming clear that this is about a dispute involving a contract from a previous employer.

Yep. Can’t help with only 1/10th of the facts. Would need to read the whole thing to decipher what was meant. I suspect that there are a few important sentences missed out.

But as has been said, going into the office with “This is what ACAS has said” carries more weight than 'this is what some random shouty bloke on an internet forum has said."

This is word for word
Title
This contract of employment is made between Eddie stobart ltd,Stretton green distribution park,Langford way,Appleton ,Warrington,wa4 4tz ( the company) and dozy----- --------

That’s word for word , the contract is a esl contract I was tuped over on a Corby chilled contract but due to that contract being guaranteed 55 hrs and esl planning max hours I changed to a esl contract
N.b it may of been a innovate contract to esl contract ,can’t remember but either way I changed to esl t&c,s, there not disputing that , there saying it doesn’t guarantee you 8 hrs per day , which funnily enough it has done since 2009 .
Thanks all I’ll take weeto advice and speak to acass , ta
