Confused over WTD

If driving, the break periods under European drivers hours rules take precedence.

Mobile workers must not work more than 6 consecutive hours without taking a break,

If your working hours total between 6 and 9 hours, working time should be interrupted by a break or breaks totalling at least 30 minutes.

If your working hours total more than 9 hours, working time should be interrupted by a break or breaks totalling at least 45 minutes, breaks should be of at least 15 minutes duration.

So basically if you work over 9 hours you need a break of at least 45mins which is the total break you are required to take throughout your shift at anytime during your shift?

from what i understand
if working for 6 hours = take at least 15m
6-9 = at least 30
9+ = at least 45

this 45 can be covered by your tacho break.

Easy way to put it before you get to 6 hours you need 15 mins to go beyond it and a 30 min break at the 9 hour point.Thats how i work it never had any bother with doing it that way.

If only working for 6 hours you don’t need any break.

You don’t need a break if you’re not working more than 6 hours working time.
You do not need to have a 30 minute break before exceeding 9 hours working time.

The rules for the working time breaks.

No worker should work more than 6 hours without a break of 15 minutes. (commonly known as the 6 hour rule)
So the rule for the 6 hour rule is:
A 15 minute break should start

  • No later than 6 hours working time from the start of the shift
    And
  • No later than 6 hours working time since the end of the last break.[/list:u][/list:u]

Total breaks in each shift should be:

Up-to 6 hours working time.

  • No break is legally required.

If the total working time in the shift is more than 6 hours but not more than 9 hours.

  • A total break/breaks of 30 minutes is required, this can be taken in 2 parts of 15 minutes each and at-least 15 minutes of the 30 minute break should be taken before going over 6 hours working time.

Or (You are legally required to comply with either the rule above, or the rule bellow but not both)

If the total working time in the shift is more than 9 hours.

  • Total break/breaks should be at-least 45 minutes and at no point in the shift should you do more than 6 hours working time before having a break of at-least 15 minutes.
  • So for the 6 hour rule a 15 minute break should be taken
  • No later than 6 hours working time from the start of the shift
  • And*
  • No later than 6 hours working time since the end of the last break.

Breaks for the working time regulations (RT(WT)R 2005) can be split into separate breaks of at-least 15 minutes each and cannot be taken at the immediate start or end of the shift.
Driving breaks count as breaks for the RT(WT)R and where appropriate breaks for the RT(WT)R count as driving breaks.

You could work a 15 hour shift with only a 45 minute break, assuming you don’t drive over 9 hours, and the point at which you need the 30 minute break for 4.5 driving falls inside your final 6 shift hours.

But the question is, would you want to? No ta!

For clarity, the above example is illegal, you cannot drive for 8 hours with only a 15 minute break, after 4.5 hours accumulated driving time you must have a 45 minute break.

Forgetting about driving time you can work any legal length of shift with a total break/breaks of 45 minutes, if you don’t reach 9 hours driving time you could do a 15 hours shift with break/breaks totalling 45 minutes.

As far as driving is concerned, theoretically you only need a second 45 minute break if you drive for 9 hours, in practice you’re not likely to accumulate exactly 4.5 hours driving twice which is why I said theoretically.

Any shift of over 9 hours working time requires a break/breaks totalling at-least 45 minutes.

For clarity, tachograph is referring to ROGs slightly senior moment, when he says the above is illegal :wink:
