Surely those who work for and supply these “buy now, pay never” companies should take some of the blame? I’ve worked with lorry and machine drivers who weren’t paid for 6months (one was owed for 9) and will moan and groan yet wont say why they carried on working.
between vosa and the hmrc and this orginization need to work closer together to stop these companys useing loop holes, and like the one not to far from me who add ( international ) into the company logo to restart and keep on trading while they desperatly trying to get o’ licences. now the three involved have all been declined to hold o’ licences i am led to belive but the have brought in some poor unsuspecting sapp on board as their transport manager and who’s very own company has collapsed or is in difficulty.so with all these people on board thats two company directors one transport manager and the original company director who and i quote from vosa can know longer have anything with the day too day running off the company can make it pay with just two trucks and two trailors thats all they are aloud to have. there has already been a piece in commercial motor about phoenix companys, now is the time for these companys and persons involved to be black listed and never trade again,the company i mentioned with ( international ) in its name went down for hundreds of thousands of pounds leaving a trail of distruction behind them.so if your the transport manager and you might reconize a close resemblance " run" my freind you realy don’t want to be involved in that outfit. belive me

Then before shutting down the original company they transfer or sell (for a very small fee) the assets to the new company and tell their customers they are making changes to their company structure and the company name is changing, plus new bank accounts etc. Some staff get transferred to the new firm, some don’t.Sounds suspiciously like PRE-PACK!!!

That’s exactly what the company I was referring to did.
They registered a new company 6 months before the original company went pop.
Suddenly Auto Recovery Services Ltd becomes Auto Recovery Services 2011 Ltd overnight, same trucks, same drivers, same management.

Egertons Recovery did exactly the same, (again all information is available at company house and in the press). The thing with them is, Ive seen some of their invoices, how they went bump when they charged what they did, is beyond me, something to do with loosing Green Flag, although that was always peanut rates anyway. I
m not having a pop at Recovery Operators here, I am well aware that some jobs are prolonged and can work out expensive.

at least he’s giving it a go.
I know It’s more costs, but what about if any business taking credit had to be insured to the level of the credit? Dodgy operarators would be stung with high premiums and the innocent wouldn’t get done with a customer going pop.
i think ul find its the companie that goes bust not the director so he is usualy free to start up again with him as director

These companies are normally the teararse firms who if they vanished, would put a lot of vosa men out of work.
Looking at the O licence applications recently a local firm is applying for a new licence, further down the page there is a public inquiry listed relating to the original licence. Confirms what has been said earlier. As far as I know the new licence was granted.
