was assaulted october 2012 … fractured skull & contusions… memory loss & loss of smell & taste lost my car & class1 automatically… now may 2013 just got my car licence back after 3 attempts & over 7 months … dvla have told my i need to be below the 3% margin of risk of a seizure or fit … i never had a fit when it happened or have had a fit since … they can’t give me a time on when i can re-apply for it as i need to— yes i need to prove to them with medical information that i have become less than that 3%… i have spoke to my GP … she is baffled with the dvla & my doctor that treated my head injury in the A&E and is a head injury speacialist cant really help me either as he says its the DVLA guidlines & he has asked for a copy so he can understand it & try & help me but has had none sent so far … all i get from the DVLA is “speak to your doctors”… i have done so & now im stuck fast with basically no job & no future … all i know is transport /general haulage … from starting out as a van boy to driver & hgv driver … working for Aone transport (leeds) & freightliner among others … adr work … roping & sheeting …trunking … i need help to get out of this mess … any idea’s anyone…?
go see your local MP mate, tell him/her what you have told us, ask them to get involved and write to DVLA on your behalf. DVLA are a law unto themselves, especially the medical dept

No expert but you could try a solicitor I suppose if a formal complaint doesn’t get you anywhere, probably need plenty of money to go down the brief route though.

So if they keep saying go and see your gp, then i’m assuming dvla will accept a medical report from said gp and the specialist? Go down the MP route, best way to start and they are free.
Go to your local DVLA office, they’ll give you a copy of all the paperwork you need. On the phone is pointless with them lot, It’s always up to you or someone else to deal with things, but never them.
What area do you live?
I had the same medical condition back in the mid 90’s.
Had licence suspended for 1 yr.
But as degsy4wheels said they should accept your medical report from gp.
I had one final mri scan and report done by hospital/gp and got all my licence catagories back in one go.
Never got no mention of 3% margin of risk of a seizure or fit.
Mind you it still plays me up to this day.
Not strictly on topic, but have you contacted the Criminal Injuries Compensation Board re compensation?

Good Morning People. I had a similar problem with DVLA. Last August took my medical at the age of 65 past with flying colours. Sent it all off to DVLA waited and waited October I was sent a letter saying I was legal to drive while they was investigating my medical health. The letter was no good to me as all my work is abroad. So I canot work. October was sent for an eye test. Still waiting. Jauary 2nd this year Ive kicked off at DVLA. They want me to have a heart scan. Done that passed with flying colours. Finally got my Licence back February 23rd this year 6 months out of work thanks to the DVLA. Now have my MP on the case he has sent me all the documentation to fill in and complain to the Goverment Ombudsman for Compensation. Ill let you know the outcome, as the man says DVLA are a law on themselves.

bullcrap how can you thank the DVLA for being out of work for 6 months, you could of driven in UK while you waited or swept floors lame excuse, no wonder UK is going down the pan!
i live in glasgow , & am in limbo at the moment … working inside at the moment with a £250 per week reduction in pay … not good … yes i have a claim in with the criminal injurys board as it was a reported crime & was caught on cctv … 2 weeks in hospital & over 3 months off work… thanks to all for the advice & comments…

Good Morning Discoman. Well said there, but you do not know the facts of the case. I mainly live in Poland, but have a property in Kent, but I work for a specialised heavy haulage company in Germany where I have been employed for the last 23 years and earn a very substantial salary. I am a British subject so I still have to do my licence through DVLA. I had to stop work due to DVLA negligence, so I stayed in Poland while this was going on and drew my Pension to which I am entitled to. Now the DVLA are saying we have to apply for our renewal, this includes you ,3 months before it runs out, due to there backlog. This Goverment and this country are in a State because of there own stupid mistakes. I would never work for a UK company while they abuse the drivers and pay crap money, I get a good wage and get respected where I work, and my job was kept open for me while the case was going on.
