but if youve been on a set shift of sun-thurs , your lifes mapped out around those days, one day at the w/ends enough,all these things is it fair to just say youll have to change or you havent got a job [hypothetically],seems a bit unfair,just wondered how do you stand if you say no thanks im happy as i am, ,can your shift be just changed to suit the work,what happens if work picks up next week ,will they change you to another shift, seems unfair to me, but i guess it the way it is these days

reading mine,it says
job title and duties
you shall be employed as an lgv c+e [class 1] driver
no mention of days,nights,shifts or what your saying
or would this bit count
in addition to the duties normally associated with this job you may be required to undertake additional or other duties nessasary to meet the needs of the company buisness
as i say it doesnt affect me [at the moment], but i just wondered cann they just say either you change shifts or you havent got a job, not bothered what shifts i do on days but dont want nights other than the odd o/t shift,i just wondered for future referenceta

I’m pretty certain that they can tell you your existing shift pattern is no longer needed and surplus to requirements as such there will be no need for this shift, however shift is available for you. I would imagine that a statutory notice of this is the 90 day period if you wanted to drag it out. I wouldn’t think what your contract says has any bearing on it either. What you where contracted for and are now required to do are very different things. The fact is you are being offered similar work (contract). The issue here seems to be not wanting to work a Saturday? If this is the case i would imagine if you had children and a rock solid argument that by working a Saturday it was infringining on your rights to a family life, or maybe a partner who did not work weekends and you could argue that it would impinge on your rights to a family life then you just may get the saturday off. The trade off though, could mean you get four days work a week and your Saturday off!! The odds are firmly stacked in the employers favour unless you’re willing to do a lot of complaining and present a very good argument and even be prepared to take it to tribunal stage.
Anyway, yes they can finish you, 90 days is all they need to change your contract and you stand able to take it to an employment tribunal!!!
As long as they give you 90 days notice then they can do what they like, its happened to me 3 yrs ago.
Correct Mike, I never signed my new contract cus I wanted out anyway so technically I was sacked and then took them to an industrial tribunal and eventually settled out of court.
Tell them your Jewish and your Sabbath day is Saturday.

When you have been on a certain shift or day pattern for a while, it is classed as ‘Custom and Practice’. Regardless of what your contract says, the Law takes the view that these are your contracted hours or days, as you’ve been on them for a while.

I’ve been working Wed to Sat for five years now. A few of us drivers were on four days a week because of the run we were on. A few years ago, the boss wanted to get us back on the main rota which is any five over seven, but let it go when one of the drivers informed him of the rule.
However, thanks to the Tories, they can do whatever they like after 90 days notice.
