I think you may be getting confused with SPLIT DAILY REST which counts as a FULL daily rest -

If you do 3 consecutive hours of REST during the day and then have 9 hours of DAILY REST at the end of the 15 hours (15 + 9 =24) then it is deemed a FULL DAILY REST and not a reduced one.

The 3 hours rest must be done en-bloc (in one go) before the 9 hours.

No you can’t work more than 15 hours a day.

The regulations require you to have at least 9 hours rest in the 24 hour period from the start of shift, therefore it’s not possible to legally have a spread-over of more than 15 hours from start to end of shift.

However if you have 3 hours rest at some point in the shift you can then have just 9 hours rest at the end of the shift and it won’t count as a reduced daily rest period as it counts as a split daily rest.

there is only one way of working more than 15 hours in a day ,and that is if you are doubled maned and if you were doubled manned you could be at work 21 hours in a day

So what is the point of this poa then is it just a matter concerning the wtd ■■

Tell that person March 2007 called and it wants its regulations back. :stuck_out_tongue: Pre April 11 2007 you could have a 16-hour day provided you had 4 hours of rest, not POA, during the shift. The 4 hours could be in one or two parts with no part less than 1-hour. This meant you could take an 8 hour rest period at the end of the shift, giving you 12 hours rest for the 24-hour period, and leaving you 16 hours for your ‘spreadover’.

Now you need 3 hours, in one lump, and 9 hours for a split shift giving a maximum spread of 15 hours.

Very little point. It is almost the same as break and if a period qualifies as POA it certainly qualifies as break, the requirements for break are less than POA. Neither POA or Break count toward your 48 hour average, 60 hour maximum weekly working totals for the WTD, so it is simply a way to to earn more money and still comply with the WTD.

If you are going to be booking a period of POA of at least 3 hours better to book it as break/rest, that way you always have the option of using the time toward a split daily rest if you have used all your available 9’s, or to keep a 9 for later in the week.

Regulation (EEC) No 3820/85

On days when the rest is not reduced in accordance with the first subparagraph, it may be taken in two or three separate periods during the 24-hour period, one of which must be of at least eight consecutive hours. In this case the minimum length of the rest shall be increased to 12 hours.

REGULATION (EC) No 561/2006

(37) For reasons of clarity and rationalisation, Regulation
(EEC) No 3820/85 should be repealed and replaced by
this Regulation,

Thanks bud i will download that and read it later many many thanks
