Can you help me

hello all,
iv just started a new job as a class 1 driver / rigger on a moving show, so setting up building a stage for the show then packing it up and moving it to the next city and doing it all again.

ive been driving hgv 1 for 4 yrs so all the basic hrs regs and break rules and things like that.

Now my question is as i am a truck driver and have to drive the show truck to the shows and then set it up does the 15 max hr a day rule 3 times a week apply and what about daily breaks am i entitled to an 11 hr break before starting work again the following day to either carry on setting up or breaking down the show?

I read somewhere that there was a bloke who worked mainly in the warehouse but every now and then he was asked to go out on the road and as he did this a certain number of times a month or within a set week peroid he had to fill out paper tachos for all the days he was in the warehouse, putting his start time and finish time of the day and work break and marked it as other work, all on the back of the tacho obviously.

can anyone shed some light on this as i need to know where i stand if i am gonna bring this up with my new boss.

I cannot see anything in this (below) which gives any exemption from REGULATION (EC) No 561/2006
I’m sure one of the site tacho GURUs will be along shortly to give you the DEFINITIVE answer

Article 3
This Regulation shall not apply to carriage by road by:

(a) vehicles used for the carriage of passengers on regular services where the route covered by the service in question does not exceed 50 kilometres;

(b) vehicles with a maximum authorised speed not exceeding 40 kilometres per hour;

(c) vehicles owned or hired without a driver by the armed services, civil defence services, fire services, and forces responsible for maintaining public order when the carriage is undertaken as a consequence of the tasks assigned to these services and is under their control;

(d) vehicles, including vehicles used in the non-commercial transport of humanitarian aid, used in emergencies or rescue operations;

(e) specialised vehicles used for medical purposes;

(f) specialised breakdown vehicles operating within a 100 km radius of their base;

(g) vehicles undergoing road tests for technical development, repair or maintenance purposes, and new or rebuilt vehicles which have not yet been put into service;

(h) vehicles or combinations of vehicles with a maximum permissible mass not exceeding 7,5 tonnes used for the non-commercial carriage of goods;

(i) commercial vehicles, which have a historic status according to the legislation of the Member State in which they are being driven and which are used for the non-commercial carriage of passengers or goods.

Sort of. There isn’t actually a 15 hours 3 times a week rule. There is a rule which allows you to reduce your daily rest 3 times between weekly rest periods, so between one weekly rest period and the next you can do 15 hour days 3 times. The rules are built around the amount of rest required in 24 hours. 11 hours rest allows you to work 13 hours maximum and a reduced rest to 9 hours allows you to work 15 hours maximum. Note the reductions allowed are 3 times between weekly rest periods and not per week, if your weekly rest was in the middle of a week it would be possible to do 6 reductions in a week.

You mean rest rather than break, they are different and while you aren’t entitled, as such, to 11 hours rest you it may be the only option if you have already taken less than 11 hours rest 3 times since your weekly rest period. If you have done that you will not be able to work more than 13 hours on the remaining days before your weekly rest and will have to take at least 11 hours rest.

On the days you don’t drive, in a week were you do drive, you will have to complete a chart for each of those days and it will need to show the other work and breaks for the WTD, assuming your boss is using the tacho to monitor the WTD. That can be by manual entries, either on the back or front of the chart although the back is the usual place for entries. If the vehicle is parked on site while you are rigging, it might be just as easy to put the chart in the tacho unit and use the mode switch to show other work and WTD breaks.
