Yes Tofer, that is correct. Amazing how many van drivers don’t know.

I never knew to be honest, I thought they were the same as for cars if <=3.5t.
i suspect most van drivers wouldn’t care even if they did know.
During a very recent training day at work I mentioned this very point, that trucks are indeed able to travel at 60mph (according to the highway code) The training bloke agreed, the speed limit for lorries is 60mph on motorways, however, as the vehicle is LIMITED by european law to 56mph if this limit is exceeded we could be prosecuted under construction and use regulations.
Not quite correct. The limited speed refers to POWERED speed, when you are on the over run going downhill, you are not under power.
On the subject on infringements we get a speed infringement if we exceed 90kph. After being advised on here that that was tosh I raised the issue with one of our managers (ex driver so he knows his stuff) and he said the company would take the point of view that the limiters are set to 85kph, that the vehicles have brakes and retarders and that I, a professional driver, allowed my vehicle to run out of control by at least 6kph whilst going downhill. Well that’s me told then, I’ll be the bloke now doing 50 waving to you as you zoom past.
sorry but if you’re running at 44t how long is it going to be before you get royally ■■■■■■ off at constantly altering your speed on a long un on the mway?
we are getting a bollocking off our lot at the minute for “overspeeding”.im in the same position as coddy, whereby my truck is set at 52 mph,and if it goes to 53,54,55,etc it registers an overspeed.whilst i know that the motorway regulations are 60mph for a hgv could someone in the know (possibly vosa) please keep me right on the following points:
1)can vosa tell on a digi tacho that you have overspeeded the set limit, but NOT exceeded 60 mph?.
2)is overspeed up to but not over 60 mph an offence?.
3)is overspeed a separeate offence to breaking the speed limit?.
clarification would be greatly appreciated.
I do know that the digi tachos store the 10 worst Overspeed offences…
I too want to know exactly what the law says on this, a lecture I went too on digi tachs, the guy said it was an offence if the truck is set at 56, to go over that for more than eg 10 seconds, as this showed up overspeed on the memory, and was now and OSL (Overspeed on Speedlimter offence) despite the law in the UK still being 60 mph for trucks on the M/ways.
So as Buck says, we are set @52mph, so we have 8mph to play with, yet the tachos are showing overspeed at 56, according to the lecture we have broken the EU law and our toenails will be extracted with pliers by VOSA, but according to UK law, we are within the speed limit.
Now since this WTD, digi tachs etc have come into force, I have yet to meet 2 people who agree on on this, is the law worded so badly it can be twisted to anyones way of thinking, esp VOSA if they are on the warpath, its seems to me even VOSA are not fully aware of exactly what is an offence and what is not in some cases.
Forget all else! The speed limit for an HGV on a road designated as a motorway is 60mph. Worry ye not at 59!!

Send VOSA an e-mail with your questions so you have a written reply - that way if you do get stopped you can produce it
its strangely quiet from the “people in the know”…

its not an ‘offence’ its an ‘infringement’. You have ‘infringed’ the vehicles set speed.

And to answer the OP’s question, yes they can sack you if you persistently exceed the vehicles set limit when you have been told not to. It’s gross misconduct.

WE are all people in the know. We can all read(uh oh) cant we? The law is written and carved in granite
Back to sleep now, till the next urban myth/nonscence rears its ugly head.
hiya,
whats the punishment for going over the top continuously if i was still driving i would qualify for it, couldn’t be doing with all the silly rules cancelling out what the law says lets make the tacho suit the law of the land just stupid the way things are at the moment,if the law says 60 you should be able to do 60 this is uk law and we do live in the uk, load of J ARTHUR RANKERS if you ask me.

Think about it ROG. The law says 60 mph so you can’t be prosecuted for doing 58 mph. Also if your company limits your lorry to 45mph and tells you not to go over it then thats what they want you to do. Easy !
