At work recently a couple of times, I’ve had infringements for WTD related stuff.
Basically what has happened is start at 10:30pm have an hours break at around 2:00am so starting again about 3:00am and not clocking out until 09:15/30 work have said I have gone over the 6 hour rule from starting again at 3:00am and not having a break after that 6 hours of work. To my mind as I have had the 1hr break it clears the WTD regs for the shift, am I being stupid or do I require to see a trumpet picture for either myself or them??
You are a trumpet. 
It’s any period of 6 hours work, not just the first 6 hours of work in the shift. About 03:00 - 09:15/30 is more than 6 hours work so you will need another 15 minute break. That break must be taken before the end of the shift because it must interrupt the work period.
The WTD regulations say that you should not exceed 6 consecutive hours working time without a break, you’ve worked from 03:00 to 09:15/30 which is over 6 consecutive hours working time so you have exceeded the allowed working time without a break.
You should have another break of at least 15 minutes at or before 09:00, or have the hour long break later so that you don’t work over 6 hours without a break.

You must have been fortunate to miss the multi page thread we had on this very topic a while back when it took many pages to convince delboytwo that it was any 6 hours and not just the first.
