Cabotage ???

Can someone be prosecuted under cabotage rules in a car?

Reason I ask is there is a local Pizza shop that employs a Bulgarian national as a delivery driver. However this guy uses his own car which is still registered on Bulgarian plates.
Bearing in mind that he is possibly doing 20 or 30 deliveries a night from the shop to the customer, that would put him well over the allowance under normal cabotage rules.

I doubt whether his car is insured for business use either (if its insured at all) but thats a different issue.

I wouldn’t have thought so, as pizza delivery isn’t a road haulage operation, apart from those dafs that domino’s have got :wink:

Its still movemoent of goods for hire or reward though, so its the same as road haulage.

If he was using the Pizza shops car then it could be argued its own account, but as hes using his own car and i would presume getting paid (whether mileage or hourly I dont know) surely thats the same as a light haulage company or courier business.

Agree. (to Jay’s post, Toowise jumped in whilst I was typing) I don’t think cabotage comes into this at all - hasn’t it been scrapped now anyway?

Would definitely be more an insurance (and valid driving license?) issue.

Round my way the UK registered cars I’ve seen used by drivers of non English origin for pizza delivery tend to have: worn out wiper blades, a few light bulbs out & at least one illegal tyre.

Cabotage only applies to goods vehicles, so unless he’s running round the houses in a unit I think he’s in the clear

If he is doing deliveries then he should come under hire and reward insurance or Git normal car insurance would not allow this and is invalid if the Co knew about it.

I think that it is illegal to use a “foreign” registered vehicle for commercial use if you live “permanant” in the UK

Most def will not have commercial insurance but nothing will happen over it boys in blue or pizza shop won’t care less
