Working a 10 hour shift as a shunter, what would be the minimum break time that you should require under the letter of the law.
A few issues arose at work recently and obviously clarification required before I put my size 10s in it?
Many thanks

Internal only yard shunter or out on the public road shunter using tacho
Bit of both really as we use tachos,

If you use tachos under EU regs then the breaks required are set in stone
What breaks are you referring to? - during shift, daily or weekly
I work from 6-4 at night, a 10 hour shift, as a shunter am I correct in thinking your required by law to take a 45 minute break within that shift

Dopey me of course he is
max of 4.5 hours driving requires a 45 min break or 15+30
Max 6 hours of work requires a 15 min break
If total hours worked (not to be confused with shift time) are 6 to 9 hours then a total of 30 break needed or15+15
If over 9 hours worked then total of 45 mins needed

If no POA recorded then the work in that 10 hours will be over 9 so a total of 45 mins of break needed for RT(WT)R but can be 15+15+15
If the driving time gets to 4.5 hours then a 45 min break needed or 15+30 for TACHO regs
Breaks can count for both but the driving time break rules take preference
Must not work/drive more than 6 hours at any point in the shift without at least a 15 min break for RT(WT)R
Didn’t realise it could be taken 3x15 minute periods.
Thanks very much for the quick response
Careful! the 3 x 15mins are only for Working Time regs, you still need 15 + 30 or 45 for tacho regs.

Providing he’ll be doing 4.5 hrs or more of driving obviously.
Do you have a link, where I can find the information regarding the breaks, ie over 9 hours for a shunter being entitled to 45 minutes as I am having difficulty with the powers that be at work
