Breaks, 45 mins

According to a Vosa man. You can only split a 45 minute break into a 15 then 30 not the other way round. I had a 35 then a 20, and vosa man tells me that the first 35 only counts as a 15. He says you can either do a 15 then a 30 or a 45, any less than a 45 is counted as a 15.

Thoughts ?

He was correct, it’s been that way since April 2007. If your first break is between 15 and 44 minutes you will need to take another break of at least 30 minutes before exceeding 4.5 hours driving.

REGULATION (EC) No 561/2006

Article 7
After a driving period of four and a half hours a driver shall
take an uninterrupted break of not less than 45 minutes,
unless he takes a rest period.
This break may be replaced by a break of at least 15 minutes
followed by a break of at least 30 minutes each distributed
over the period in such a way as to comply with the provisions
of the first paragraph.

I had forggoten that and thought it applied either way. :blush: :grimacing:

Got to say its a crazy rulling. Anyone else think so ?

Also what was wrong with the old method of two breaks of anything between 15 and 30 that added up to at least 45 ? I always thought that was fine myself. eg 25 and 20

30 min break
drive 4 hrs + 29 mins
15 min break
drive 4 hrs + 30 mins

8 hours and 59 mins with only a 15 min break !!!

Basically it allowed you to drive for too long with only a 15 minute break.

Start driving and after 5 minutes have a 30 minute break, then after another 4 hours 25 minutes driving you could have a 15 minute break, you were then good to drive for another 4.5 hours before needing another break, that’s 8 hours and 55 minutes driving with only a 15 minute break.

That’s why it was changed :wink:

But ROG it’s illegal to take a break until you have done at least 5 minutes driving, my mate told me that. :stuck_out_tongue: :stuck_out_tongue:

I was told a 48 minute break doesn’t count either, it must be exactly 45 minutes on an atomic clock :laughing:

In that case, you can’t do a 15 then a 30! As the 30 is less than 45 therefore by his logic would be counted as a 15…!!

I would say that the VOSA guy was referring to the first break only in which case that is correct
