I think there should be a prosecution. Cutting up a junction is one of my bugbares. No need for it unless youre in a very large vehicle and cant help it.

100% this. They do it so often it’s just habit. They’re not even aware they’re doing it.
The article says he doesn’t want to prosecute the drive. And hope it starts a discussion on driver safety
I’d prosecute him for sure as he was on the wrong side of the road.
Although not sure how it would happen as cyclists don’t have insurance.
But I’d deffinatly get the police involved and try to make a claim

I saw a dashcam clip on FB a few months ago that had been posted by a woman of a car overtaking her as she sat at a pedestrian crossing. It narrowly missed two men who were crossing.
She too recieved dogs abuse because, 30 seconds prior to the incident, her dash cam showed she had been doing 32mph and was therefore no better as she was speeding

If her speedo showed 30 I’d doubt she exceeded 30.

I cycle most days for a bit of exercise.
I know the BMW was in the wrong, and the cyclist was in the right but…
Am I the only one that thinks the cyclist was daft to be sat in that position in the right hand side? Cars (and truck) do cut corners, and are not always driven by people that are aware of what is around them…
Surely self preservation comes into it somewhere?

Well he could always have waited at the right rear of the left turning car until he pulled out and away. Of course he shouldn’t have to and he completed a perfectly legitimate and legal manoeuvre, but as said above self preservation must kick in sometimes. As the sign on the mirror says “this person is responsible for your safety”.

I wouldn’t have gone up the outside of the left turning car. I would have been in the right hand lane, but not as far over.
Incidentally and I have checked, I am older than the cyclist so have been cycling longer than him, I have turned right many times at T junctions and so far have never been crushed or mashed by a knuckle dragger in a BMW.
Therefore I have finally found a topic on this forum that I can contribute to without comeback.

Behind the left turning car till he had left the junction would be the sensible persons choice.
Yeah he shouldn’t have to but much like the cyclists who sit on the near side of a left turning truck because “he should have properly adjusted mirrors”, what you’re essentially doing is putting your life in the hands of someone you don’t know
to be fair and i hate to admit it but the cyclist for once is mostly 99% blameless in this one other than nit picking his self awareness.

Had the cyclist waited for the car to turn left before positioning himself, he would still have had to pull up to the T junction at least towards the left side of the centre line, or someone else behind him wanting to turn left would have been inconvenienced and quite likely going ape (cos they haven’t a bloody minute to live) due to being held up 3 seconds, he would be on a loser no matter what he did.
The twerp in the car that cut the corner without looking where he was going was completely in the wrong, i’m just glad the cyclist wasn’t seriously hurt.
I do have a certain sympathy with the twerp in the car, that sympathy being the quite ridiculous blind spots that so many vehicles now have, fashion dictates higher waistlines of cars, so the windows end up much narrower in height, often darkened to drug dealer standard behind the B pillars, a port hole for a bloody back window, door mirrors that are part of styling instead of being useful for vision, and last but far from least ridiculously thick A pillars, now slanted ever further back so at a given sight level they are extraordinarily thick giving hugh blind spots on those all important junctions.
Yes we have similar issues in lorries, our main problem being wardrobe sized mirror casings sitting right beside the driver, often enough the casings being the wrong way round…if you look at many MAN a prime example, if the mirrors were turned around on the arms the thickest part housing the motors would be hidden behind the mirror itself and not taking another 3" of vision out for no useful purpose…BUT…we are professional drivers, or so it says at the top of this page, and i can only assume that everyone who posts here accepts that by doing so they consider themselves professional drivers, as such we take extra care to clear those blind spots we have no option but to accept as part of our lot…the car driver in question would not (unless he happens to drive for a living) be considered a professional, so no one would expect him to come up to our standard of driving.
ie, i would not expect an off duty professional driver to make that same mistake and clean the innocent cyclist up as he did.

Ironically I wouldn’t ever risk riding a bicycle on the roads.However even driving a car these days means looking left first when pulling up to a give way line and then often positioning the thing further to the left than is ideal when turning right precisely because of these type of idiots.Also actually turning left from a junction often results in the similar situation of a nutter deciding to turn right at the last moment with no indicators and cutting the junction to the point of colliding with even left turning traffic.
Then there’s the even more lethal type of maniacs who straight line and cut right hand bends against oncoming traffic.To the point now where I usually instinctively drive to the kerb through left handers especially the typically blind over grown ones.In the knowledge that a nutter will be approaching across the dividing line sooner or later.On that note this is all about the most basic of driving skills nothing to do with ‘professionals’ or not.Having been taught not to cut corners or bends as one of the first rules taught to me by my dad as a learner driver.
While it’s laughable to hear so called driving enthusiasts droning on about the cornering ability of their latest silly quick shopping cars while at the same time looking for every opportunity to take a racing line through and straighten out every corner and bend they meet on the road.
The bottom line is, the motorist is 100% in the wrong. Should be prosecuted. End of. One can pick this to pieces as much as one cares, but the cyclist had every right to be there, self preservation or not.
The cyclist is correctly positioned.
I suspect the car driver ‘learned’ in a Micra or similar, and has never adjusted to the longer bonnet of the BMW.
People who buy BMs often seem to be completely unaware of how different they are from most cars: long bonnets and rear-wheel drive for starters.

It shouldn’t be up to him, the police should be referring this to the CPS for prosecution out of public interest, if its in the public interest to clock drivers for a few clicks above the speed limit, then it is absolutely in the public interest to prosecute dicks like that.
