I would imagine if this idea becomes law, there is no way you would dive past a cyclist. In fact if I saw one I would probably stop the vehicle I was driving until said cyclist was not in a position to claim I had endangered his/her life with no chance of me being able to prove otherwise.

Alternatively, the only way a driver would be able to prove he was not responsible for an accident with a cyclist, would be to have multiple cameras mounted on the vehicle, and operating at all times.

The cyclists that already take responsibility for their own survival, are generally the ones who do.

If that comes in, how long until somebody decides to ‘crash for cash’ as it were. People like this are the problem. Fair enough not all cyclists are like this, but out of any road user to run a red light, you can bet it’ll probably be a cyclist.

Take a look at some of his other videos, impatient and treats the road like it’s supposed to belong to him, anyone else is a [zb] too apparently.

This one makes me laugh why the hell is he in the middle of the road screaming at cars when there’s a cycle lane (which hes not in btw when he meets the car)

I fear it will be very hard to prove your innocence if this was to become law. An example being that you hit a cyclist who stupidly entered your blind spot. Now the driver will probably automatically be to blame because you failed to notice the cyclist. Goes against the innocent until proven guilty thing.

It says in the story that cyclists would also be automatically at fault for hitting pedestrians. How about we all start walking in front of cyclists in the same way they veer around the road and pull off stupid maneuvers in front of and at the side of trucks and then sue them for personal injury. Or how about parking your truck at the side of the road further ahead, waiting for a cyclist to approach and then exist your cab, directly in to his path and then make a claim against him due to his negligent and dangerous riding.

I am of course joking, but this whole thing is nothing more than a joke. How can any one keep a straight face while claiming automatic guilt is sensible or even acceptable in a modern post medieval society. What next, Jews are always at fault regardless, black people? people wearing blue socks? Surely this has to be a wind up.

yeah and all them deaths and injuries are all the drivers fault■■? haven’t you watched the videos off youtube the others have posted on this thread?? a ■■■■ on 2 wheels in my opinion.

We are professional that’s why more idiots aren’t killed, and because we know cyclists have no road sense we have to have quick reflexes. How about it be law that if there is a cycle lane cyclists must use it and they should all have working lights and have to wear reflective clothing and last but not least have insurance.

Agree with this post. I think this removes the basic tenet that people are innocent until proven guilty.

If somebody is raped or murdered the police have to gather evidence and the defendant proven guilty. Why should any other area of our lives be any different.

I read about this today on the BBC Scotland news site.
What they want to do in this ‘Strict Liability Law’ is to hold all motoroists to be at fault in the Civil Courts for all accidents.
So, in the event of an accident,if the police dont hold the motorist to be at fault, these loonies want to make the opposite judgement in a Civil Court automatic!
Do they think that any driver who ends up in the Civil Court wont call the police to give evidence?
It’s time cyclists were isued with number plates and charged for using the roads like everyone else.
I note also that the BBC quotes supporters of the campaign for strict liablity as saying it will greatly reduce the time it takes for accident victims to win compensation.
Its not about road safety but cash.
I wonder which political party will be the one to introduce this law at Holyrood? My bet is the Greens, everybody in the world is at fault except them.

Once they get a few private court accident cases against themselves cyclists will soon wish they hadn’t bothered with changing it.

The reason the death and injuries haven’t been mentioned is that nobody here believes that this law will do anything to reduce the casualties.

Why you all getting your ■■■■■■■ in a bunch? As said in a previous post its already used in the majority of European countries. Surely a progressive country like Scotland should have it. It’s not as if cyclists are going to start throwing themselves in front of trucks is it.
Maybe it would be better if we tried the Belgian way, every road built must have bike lanes, completely seperated from the road, if you turn and hit one then it’s your fault. Again I can’t see many cyclists speeding up to get hit by a truck on the off chance of getting a few quid, after all they usually come off second best by a long way.

There are a good number of cyclists who drive lorries ,I am one.Too often cyclists do stupid things ,they dont check behind ,dont use lights and wear dark coloured clothes.A court would throw out most of the claims that arise.

True, but its all the grief that goes with it.

Leaving aside the unhealthy idea of someone being guilty till proven innocent, how would this help prevent accidents?
No one sets out to be involved in a RTA. :confused:
Could infact have the opposite effect and increase accidents as cyclists might take unnecessary risks knowing they would be exempt from any kind of blame.

I cycle too but its these idiots who think they own the road, the ones for example who ride 2 or 3 abreast hogging one side of the road even though they have vehicles behind which really boil my ■■■■. :imp:
