to be honest bob i think you were done over. they dont have any rights to breathalise you or take urine tests. since there was now no barrier i would have told them to zb right off and contact your employer and sort out the claim with them. what a bloody cheek who do they think they are. :imp: :imp: :imp:

whats the worst thing they could have done… banned you from their site. i would have stood my ground and got them to call the police as they wouldnt have got anything out of me apart from registration number and company address.

This reminds me of the knobheads who ran the T5 project at Heathrow; Our drivers had to have a medical to go onsite, and they expected us to provide our addresses, any convictions, medical history etc. I (and others) wrote a load of crap on the forms-but does your employer have the right to give a customer your details? TM at the time said it was a small price to pay for getting the work. I even got hauled onto the carpet for arriving late, being obstructive with the medical staff and “telling lies” on the forms… :unamused:

As others have said, i’d have given them my name, reg, and company details and nothing more. Then back at the yard, fill out an accident form, and let the companies sort it out.

They have no right to detain you against your wishes, if they believe you have committed an offence then they should get police to deal with it. The barrier issue is a civil matter, unless they claim it was deliberate, then it is criminal damage and a police matter.

The police wouldn’t be interested, if you called them they would just ask you if you can walk off the site!

But it got the desired result, not a lot of point in walking off the site at 3am if you are 100 mles from home and no way of getting there.

Perhaps i should clarify what i meant. Your right with the DNA test, they can get [zb]'d without a warrant, but for the urine sample i can’t see too much of a problem if i was made fully aware of what it was going to be used for, depending on the situation. Principles don’t pay the bills.

At the time it seemed the best solution, all I wanted to do was go home and go to bed.

Our TM did speak to the high ups, and they said that it is a condition of being on sainsburys property, that anyone is liable to a search, drug test, or alcohol test

They don’t keep you waiting for hours to take your money either.

A lot of their C/out staff look under the influence anyway; God I hate their “how’s your day?” “what’ve you been upto?” “I’m so tired-been at college 10 til 1 and I’ve been here since 5 o’clock (it’s now 7pm)” I don’t care mate…I’m just annoyed the wife came to your till when I wanted to go to the big titted brunette sat behind you…

I think they have breached your human rights.
you need to get in touch with Sainsburys and tell them so,then ask for all your personel details and samples to be returned to you within 14 days other wise you will sue them for a breach of you human rights.

I think you’ll find your company will now be gettin’ the £500 medical bill with the claim for the barrier.

For the barrier maybe, for the medical bill no chance. It was Sainsbury’s choice to employ a medical contractor to take tests at £500 for what is essentially their own personal curiosity, they cannot charge the driver’s company for it.

I’d have refused a breath and urine test and said that if they want to do them then they’ll need to ask the police as they have no right. If they suspected you of drink or drug driving then the police should be involved, they do not have the power to do it themselves unless you agree, what’s next, cavity searches after they ask to see inside your trailer before you leave?

So no problem, i picked the barrier up, put it to one side, and went back to security to report my incident. what do you guys think ?

I worked at hams hall for a few years and accompanied drivers who took the tests a couple of times as a witness, employed drivers always had to take test if they hit something. Even if delivering to great Yarmouth you would have to drive back to hams hall and take tests, I asked how they could ask a driver to drive back that far who they expected could be drunk or drugged up. They sad we don’t suspect him it just something the HQ says has to happen. The driver and witness get paid while waiting for the specialist to show up so it’s not all bad just another PC thing you have to put up with at these large companies. Never heard of a single driver failing but a few warehouse staff got sent home in taxi’s, the way they loaded trailers I’m surprised the specialist wasn’t there full time.

That’s what has always made me laugh at our place. Have an accident and then you are allowed to continue driving all day, return to the depot and then have an alcohol test.
