are they tacho exempt, talking to a driver yesterday and he said he was driving 7 days a week , 5 days on the bins ,then 2 days on agency at the weekend and he could do this as bin lorries are exempt , is it true

Among the list of exempt vehicles is the following.
vehicles used in connection with door-to-door household refuse collection and disposal
But that is irrelevant in this case. He is driving under EU rules at some point during the week, I presume his agency work comes under EU rules, which means he has to observe the weekly and daily rest requirements. By working 7 days he isn’t doing so, therefore what he is doing is not legal. The work he does on the refuse truck would be counted as ‘Other Work’ under the EU regs.
There is nothing to stop him doing a bit of agency work at the weekends as long as he complies with the weekly rest requirements, at least one full weekly rest in every two weeks.
