No idea mate. No one has said anything to me other than places to go and things to do. Been out all week.

I will be back later this afternoon and will find out. Even if it was reported it wouldnt be a problem. My boss has seen us having a drink if we are parked up in a company yard at another site. He came over and had one with us so cant say anything.

Aye mate. Would be much better if he came storming over. Took the cans from our hands. Poured them down the drain. Then search our cabs for more before doing the same to any extras. Before then sacking us for gross misconduct and having someone ■■■■■■ us from the site. All whilst we were wearing our hi viz vests fully done up for 360 protection.

I get a feeling whatever i write someone is goinf to find wrong with it.

Joking aside… for long distance tramping im thinking its the way to go. I sometimes am away for 2 weeks at a time. And being able to throw my chilled/frozen in the big fridge and use the little one for the other would be amazing.

As it stands with a tautliner i cant really have frozen food. If i could get my girl to make me meals and freeze them then id be much happier. I rarely park in a place that gives a meal voucher (only when company insists due to load). And even when i do get the voucher the food is never up to my standards, with my stove and microwave i can always do something more healthy and tastier (just sometimes i cba). I could get one of those chiller boxes i suppose but i like having the passenger seat space for othet stuff.

As someone asked if i got put on the naughty step. I never made it back last night and ran in this morning. No problem for me as my girl is away until lunchtime so another night out money and 8 hours wages for 2 hours work. I was going to have a beer last night but couldnt make it to a decent place to park so instead got an indian delivered to my truck (the food type not a brown women). And no nothing was said other than thanks and enjoy the rest of the weekend.

Anyway…

There are 2 offences here to consider, and it’s worth asking why they exist.

  1. Driving while over the prescribed limit. That’s an easy one isn’t it… you were caught driving while having consumed enough alcohol to exceed one of the limits: breath, blood, or urine etc and society doesn’t want drunk people driving motor vehicles.

Now let’s enter the era of the cever-dicky loophole lawyer in the 70s and 80s. “But, when my client was found in the car by police he was so drunk as to be incapable of driving… so the offence of driving while over prescribed limit cannot be satisfied”.

That brought into being offence No 2.

  1. To remove ‘driving’ from the situation they created “being in charge of a motor vehicle” etc. Driving, or the intention to drive, or the attempt to drive, is no longer part of the argument. If you are ‘in charge’ of your motor vehicle whilst over the prescibed limits as per offence 1, then the offence is complete.

Then the 1988 Road Traffic Act arrived and both the offences were amalgamated into one offence under Section 5.

There’s a defence to the ‘in charge’ bit, that the driver can prove there is no liklihood of them driving whilst over the limits. In my eyes, the only sensible way you can prove that is if you don’t have the keys with you (or you’re locked into a yard etc etc). Pointing to drivers’ hours and rest requirements just points to a lesser probability of you not driving and not an absolute proof.

San Miguel is 5%… I’d start feeling uncomfortable at the prospect of having that argument with en ex-pay-corps copper about alcohol levels after 2 500m cans of that.

Loads of guys down the years have been knocked up in the middle of the night by bored coppers and nabbed for being ‘in charge’ as above so it is something to think about if you’re going to have a beer or two…

I still say a good brief would get you off in that case, unless you were completely off yer ■■■■ rat arsed with no chance of sobering up in next 8 or so hours that is.

Qhunter , I don’t believe that bored coppers would wake up sleeping drivers , under what suspicion and cause ?
The copper stood in the bar seeing who is drinking then follow them to their cab , wait a few hours then bang the cab door , I don’t think so .

Disturbing a drivers rest will cause fatigue and an accident .

I suppose if they did knock you up…(oooer Mrs :smiley: ,) you’d have a case of them interrupting your daily rest, and claim to be unable to start for another 9/11 hours,…is that legit?

Coppers had to break the window to wake me up…and promptly nicked.

Before you get your tampon in a twist there are two things to consider; firstly the op was not caught driving over the limit, something you would have ascertained if you’d read the post properly instead of going into full know it all mode. Secondly, what makes you think that anybody cares what you think?

Is lack of class an offence?

I can always remember seeing a Russian truck parked on the beach in a small fishing village in Portugal , there was no way you could get an artic down there with twisty narrow streets built for horse and carts , but somehow Radinov Histatins got it there .
When walking past the GNR police station , I heard a lot of commotion and shouting , he was legless , told to sleep it off .
If you load out the French oil/gas or fuel refineries , they breathe test drivers , if over the limit , told to park up and come back in 9 hours , the Gendarmerie are not called .
