Away from base recording rest periods

work mate has been fined 135 euro for not showing a 24 hour rest at calais by the gendarmarie at mount blanc french side,the copper smelt of beer,im told.his km reading was the same,truck had not moved,i put swr -start weekly rest and eod-end of duty,and when start again put ewr-end weeklyrest and sod-start of duty,but the tacho is not left in the head,thought the law applies to registration of the truck,as a driver could jump in my wagon when i amnot in it.was the gendarme correct.also the fine was 7000 euro for each cmr that the permits title holder did match up to ,ie the permits name was different to the name on the cmr and fine was 1000 each cmr,the driver had 7 cmrs and threw the keys at the copper and told him hitching back to uk in next truck that stopped so the copper accepted the 135,imagine explaining to his bosses and the extra paperwork.are you supposed to record a 45 and 24 off when not in the uk.

To record a weekly rest on tacho cards would require the driver to disturb that rest by changing cards.

attention was attracted as he had a bust water hose on a super space daf,was told if not rescued within an hour then a tow truck would come at owners expense,my theory is that some one may have rung a mate up on the french side to say haulier with defective and badly maintained truck so worth a pull and tug on other side of tunnel,there are cameras all over the place down there so maybe were watching on cctv.

There is no legal requirement to record daily or weekly rest, he shouldn’t have paid the deposit. He can appeal and he should under these circumstances get it back.

It would have bothered them more if you had done it, they tend to take a very dim few of things written on the front of the chart outside the centre field. You might have had to have a good old argument to avoid a fine if you had done it…

I’ve lost count of the arguments I’ve had with different companies that want me to write things and draw lines on a tacho. I have always told them that if it was a legal requirement, the tacho would have a button that does it.
And yes, swapping tacho’s to record weekly rest would be classed as doing work related to driving and then denying you did it, although they do moan about it and have done to me in the past. The last one told me that when double manning, which involved 18 hrs driving, we had to change the cards smack on 24 hrs and insert new ones, Yea, right. I’m going to set the alarm, for that ain’t I. ■■■■■■.

When on the analog cards having 24,s off abroad,Why leave it out :question: we just used to put a card in for the break only, and even if overlapped it was never a problem, because no duty is shown on the card.
With other firms cmr,s i always check them and fill in consecutive carriers bit and put my truck number on it,or if on groupage with a lot of cmr.s just do a covering one of your own,simples.
If you pay a fine in France you have right to ask for a contestation form to be filled in, which means you disagree with the offence and the deposit paid ,i will try and find the link for this form, i think its on the AA or RAC sites.
It must also be more paperwork for the official involved ,as twice i have had small fines (135eu) dropped after asking for this.
