I work for the Probation Service, my area in this field is actually Unpaid work. HGV Drivers who work Monday-Friday/Saturday should not be doing Unpaid Work for the following reason:

A rest is an uninterrupted period where a driver may freely dispose of his time. Time spent working
in other employment or under obligation or instruction, regardless of the occupation type, cannot be
counted as rest, including work where you are self-employed.

I have sucessfully returned Orders back to both Magistrates & Crown Courts due to the Order being unworkable and given the Courts the above information. I have had some drivers complete their Orders who were working 4 on 4 off.

but what alternative do the courts then give the driver?
surely they don’t just quash the unpaid work order and leave it at that?

Obviously they give an alternative sentence, the last driver ended up with a Electronic Curfew. There are also other disposals depending on the individuals criminogenic needs and at what level sentencing the Courts set. If I was in front of the Judge or Magistrate and at custody level then I would keep my mouth shut and take the Unpaid Work, I would then mention to the probation service about me being an HGV driver and ask for the sentence to be reviewed(you can do this with any sentence within 56 days) because in my experience once you’ve ended up with a community Order they won’t resentence to custody(unless you re-offend or breach it).

Got caught fly tipping but I was a fair bit slimmer then and I could run. If i got caught now I’d be arrested.

Unloading in Luxembourg when the place was stormed by SWAT squad with UZI´s and various otheer weapons released about 3 hours later

Not quite arrested but in a pub in Stirling one night years ago I was concerned when this guy kept giving me the eye.He then came over and asked if I was doing anything for awhile,could I spare a mo.Turned out he was a detective and was looking for guys for a line up so off I went.Into the local nick and I joined 5 others all in the region of 6ft in a line up then they brought the suspect in…5ft soaking wet if he was that…got their man…while we got 2/6d for our trouble.

Got arrested in Dublin in 1972 for demolishing a phone box in Dublin City centre. Finished up in court but case thrown out and copper got grief from judge for wasting everybody’s time.

Three, I think (in connection with driving etc). A fair few more for matters unconnected with their work - Including one for murder!

I was questioned in a murder inquiry once, as a result of a break showing on my tacho (7.5t) at the time in question - does that count?

Also had statements taken in 2 other murder inquiries - I really don’t look that dodgy!

1 for me. But it was for a domestic,nothing to do with trucking…

Hiya…well i had just tipped at a grass drying plant nr redmile notts(belviour castle area) it was about 1700hrs november
3rd (saturday) traveling towards nottingham(going very dark).i go through redmile and pedleing it along this lane. as i go
round this bend(S39 foden twin headlights 2 spots under the bumper and a tipper trailer going bang bang on every bump
in the road) hunting dogs appeared through the edge as horses come over the top, strait into my path.WHOOPS…
not very good.a few words change lips. one chap on a horse was almost hit with a lister donkey starting handle,
so off we go…no problem…on christmas day, about 52 days later theres a knock on the door, 2 bobbies standing there.
now this is where the ARRESTED bit come in.the story goes on and on. no i did’nt go to jail (well not after the christmas day)
maybe if prince charles had have been in the hunt (which he usually was) i may have been locked up.
when the court summonds was been procesed, the main man in notts was big on the anti bloodsport scene. this was in my
faviour…whoopeeeee, i got away with the whole issue.my birthday is in january every present i got had a picture of a horse
on it…all my cards had horses on them…i got sick of seeing blasted horses.

Use to night drive - after a huge accident was arrested at 3am on suspicion of causing death by dangerous driving - just in case the bloke in the back of the ambulance died as they rushed him to hopsital…!

Released on bail to appear at station within 24 hours.

Attended the station next day; just as one of the Constables was going on a butty run, brought me back a lovely bacon butty & a cuppa tea. Was then released as the blood test on the guy in intensive care showed he was twice the drink drive limit and the accident investigator agreed with my side of the story.
