Can someone reply to the one asking why there are lorries in cities.
i would have thought that until the government find a cheaper alternative lorries will continue to go into London,i personally try to avoid cities like the plague as I absolutely detest driving in them, they put a lot of freight on rail but lorries are still cheaper and they get to the delivery point, trains cannot, vans are not an option, they could build what could be called superhubs just outside every city where lorries could drop the load off but then customers would not want to collect from them, whichever way you look at it its a no win situation
Surely Tesco driver is completely irresponsible if they were unable to stop for the red light? The cyclist is obviously not the sharpest tool in the box for getting anywhere near Tesco truck
This is just me commenting on the video without reading any comments on here because from time to time people on here do sway my opinion. But I think that cyclists is pan bread waiting to happen, and quite frankly the speed he is going at you could miss him in your mirrors in the blink of a eye.
There is a super single out there with the guys head written all over it I’m afraid.

Truck definitely runs a red light. Manslaughter charge if cyclist had been killed. Quick verdict - possible 10 years in prison.
Doesn’t matter how stupid the cyclist was and he was without doubt as dim a can be… the truck driver should have his license stuffed down his pants.
10 years! Absolutely no chance of getting anywhere near that my friend. He would, if anything, been charged with careless driving, max penalty 5 years, that’s maximum with very little chance of doing a single year. Fined & banned if he was very unlucky due to the poor positioning of the cyclist.
If the cyclist had been killed it would have been a much more serious charge. Potentially causing death by dangerous driving - leading to manslaughter - which carries a Max sentence of 10 years in prison. Hopefully that has spelled it out for you.
And before anyone bangs on about the stupidity of the cyclist - I’ve already said he was dim as can be.
Absolute tosh I’m afraid, the maximum for dangerous driving is 14 years, it doesn’t lead to manslaughter at all. The vast majority of cases are then dropped to the, easier to prove according to the CPS, lesser charge of careless driving with, as I’ve said, a max of five years. In this case the driver would have been unlucky in the extreme to get any jail time, & talk of ten years is pure fantasy. Take this recent event as an example.
A driver who ran a red light and killed a cyclist who was riding on a pedestrian crossing has escaped jail after being found guilty of causing death by careless driving.
Rouguiatou Fofana was sentenced to nine months in prison suspended for two years at Coventry Crown Court on Friday for causing the death of Craig Mulligan.
According to the Coventry Telegraph’s Daniel Smith and Sam Dimmer, Fofana, 34, was originally charged with causing death by dangerous driving after hitting 34-year-old Mr Mulligan on November 1, 2012.
The court heard that she was travelling at 32-38mph in a 30mph zone and made no attempt to slow down when the lights on the crossing turned red.
There are plenty of examples of this type of sentence, not too many of long sentences given out in similar circumstances, feel free to browse the web.
Hope this has spelt it out a bit better for you.
Instead of using words such as “absolute” which means you cannot possibly be right, perhaps you should look up the word “potentially” which means I cannot be wrong. Moving on from spelling it out yet again… In this country if you unlawfully take another person’s life that is not murder - then usually you may be considered for manslaughter - simple really - if you commit a crime during which someone dies (unintentially) then what you did may have led to manslaughter- which carries a max of 10 years. Like it or not - that pretty much can’t be wrong.
Seen as there has been no case, no charge, no hearing and no conviction or sentence, then you and your tosh cannot be right.

Of course there hasn’t, but you would know that as you started the “what if” scenario in the first place. The point I’m trying to get across is that, it’s virtually impossible to get anywhere near the maximum jail sentence allowed in this country for killing a cyclist, regardless of the circumstances. If you care to read up on this you would find that, as far as driving deaths are concerned, someone dying as a result of an accident is classed as death by dangerous/careless driving, both of which can be considered as manslaughter but are not, due to the fact that they are caused by someone driving, is that sinking in yet?

That doesn’t change the potential. Which is what I have pointed out. Not me struggling to understand here… Clearly each case is looked at based on several factors, not least of those is mitigating circumstances. What I see in your words is massive assumption that you can read the judge’s mind and decide what charges the police and cps will run with - now that (to be frank) is utter tosh.

When I’m having debates with people in forums I tend to form a picture of them in my mind. My vision of Billy is that of an intelligent person, well capable of standing his own ground and more than capable of fighting his own corner. Conversely you counger up a vision of a thumb sucking dribbler who needs a new set of crayons - thank you for the welcome.

how about the minibus driver who caused the death of that lass in the crash on the M62 last year, he got just over 6 years in jail?

Dipper_Dave:
I always thought the max sentence for manslaughter was ‘life’, especially if there was only very minor provocation.
Edit: To help Spence out a bit he may be confusing USA & UK as they have vehicular homicide / manslaughter across the pond.
The maximum sentence for manslaughter has been life imprisonment for the past 100+ years. The maximum for death by dangerous driving used to be 10 years, but was increased to 14 years about 4 years ago.
So - maximum 10 years for manslaughter? “Utter tosh”, were his words, weren’t they?
Spence I still think your coming at your own ‘what if’ from the wrong angle.
This is basic armchair legal expert stuff, I should know I, m well into my 10th year studying google.
Anyway say I robbed my local shop I would not face charges of indecent exposure, then again I might if I was ■■■■ but as a lesser crime than theft it may not be relevant (those that have seen me naked may disagree)…
So the CPS will be sure to use the correct sentencing stratergy to fit the alleged crime.
For manslaughter to be used the Tesco driver would have to pull over after the incident leave his vehicle and kill the cyclist with his bare hands or weapon of choice.
Due to minimal provocation he would be lucky with 10 years for this IMHO.
I could go on about the importance of using the correct prosecution method to avoid misstrials, unsafe verdicts etc but I have’nt got to that google page yet…
