Another London cyclist is lucky he lived to tell the tale

Truck definitely runs a red light. Manslaughter charge if cyclist had been killed. Quick verdict - possible 10 years in prison.

Doesn’t matter how stupid the cyclist was and he was without doubt as dim a can be… the truck driver should have his license stuffed down his pants.

10 years! Absolutely no chance of getting anywhere near that my friend. He would, if anything, been charged with careless driving, max penalty 5 years, that’s maximum with very little chance of doing a single year. Fined & banned if he was very unlucky due to the poor positioning of the cyclist.

If the cyclist had given way to the bus at the start, which he should have done, there would be no problem, the Gov should do us all a favour, keep them on the pavement.

I just can’t understand why cyclist’s would want to go down the inside of something that big, they will not wait for anyone, yes maybe there is some blame on the truck driver for not looking/planning the situation. Surely there should be some education for cyclists, just wait in view of the vehicles mirror and stay behind until a manoeuvre has been carried out .Only takes a few seconds to save a life and to loose one.

bit like that guy on the motor bike that did just that… that was a sad one though hurt and broken bones yeah but to die on your own film that’s [zb] …

If that’s the one where the car pulled out on him on a straight country lane in daylight, then he was doing nothing wrong. His camera showed the car far in the distance yet it still pulled out on him. I couldn’t believe the idiot response’s from the car driver’s blaming the motorcycle rider. The person who pulled into his path should have been done with manslaughter.

Some people have balls…

And some don’t.

I am trying to work out why the Tesco lorry moved away from the left kerb in the first place … not that is any reason for the cyclist to try and commit suicide

Nasty, neither party covered themselves in glory, the cyclist won’t be around for long if he carries on like this, the lorry driver would get most of the blame had they connected but the idiot cyclist would still be just as dead/wrecked.

Eh?

The light was RED… If you are a driver - go get your eyes tested. - soon please.

If the cyclist had been killed it would have been a much more serious charge. Potentially causing death by dangerous driving - leading to manslaughter - which carries a Max sentence of 10 years in prison. Hopefully that has spelled it out for you.

And before anyone bangs on about the stupidity of the cyclist - I’ve already said he was dim as can be.

Absolute tosh I’m afraid, the maximum for dangerous driving is 14 years, it doesn’t lead to manslaughter at all. The vast majority of cases are then dropped to the, easier to prove according to the CPS, lesser charge of careless driving with, as I’ve said, a max of five years. In this case the driver would have been unlucky in the extreme to get any jail time, & talk of ten years is pure fantasy. Take this recent event as an example.

A driver who ran a red light and killed a cyclist who was riding on a pedestrian crossing has escaped jail after being found guilty of causing death by careless driving.

Rouguiatou Fofana was sentenced to nine months in prison suspended for two years at Coventry Crown Court on Friday for causing the death of Craig Mulligan.

According to the Coventry Telegraph’s Daniel Smith and Sam Dimmer, Fofana, 34, was originally charged with causing death by dangerous driving after hitting 34-year-old Mr Mulligan on November 1, 2012.

The court heard that she was travelling at 32-38mph in a 30mph zone and made no attempt to slow down when the lights on the crossing turned red.
There are plenty of examples of this type of sentence, not too many of long sentences given out in similar circumstances, feel free to browse the web.
Hope this has spelt it out a bit better for you.

I think he means he didn’t even consider looking at the lights when he first watched it as most of his attention was drawn to seeing if Mr lycra got squished or not.

I think he was loking ahead as it looks like after the lights it squeezes down to one lane. He thought the flow of traffic was picking up so started to move over early until the car and van in front stopped.
Maybe a case of looking so far ahead on the road that he forgot to keep a check of what was happening a little closer to him.

the tosco driver had split the lanes to prevent anyone coming up the inside other than some pedal power hippy or leather clad crotch rocket biker.

yes he was wrong to cut in and jump the light but the bike was far worse.
