Another Hard Shoulder Question

I was just wondering what the rules are for parking on the hard shoulder on the exit of services?

Regularly see trucks parked there when services are full.

Also, on a side note, would you still be required to pay if parked there?

there are 2 signs 1 is Motorway Starts
the second is Motorway Ends

I did it on wooley edge ,you couldnt get a ■■■ paper in the truck park ,so i park on hard shoulder on the run up to the mway,there was at least 5 other trucks doing the same,copper opened the passenger side and shouted move it and slammed the door,all the others moved on sharply, :blush: i wrote on the back of the tacho and never had a comeback.

1.Same rules as Motorway hard shoulder. ie you dont.
2. That doesn’t make it right.

and you can keep doing that till you get into one to park :wink:

There’s no reason to park there. The tacho laws clearly allow you to keep going until you do find a suitable place to park.

If you pulled into the services and there was no where to legally park then you can carry on to a suitable place to stop, regardless of how far it is. End of.

nothing stating how far or long just you cant use the argument to complete the whole journey

Unforeseen events
Provided that road safety is not jeopardised, and to enable a driver to reach a suitable stopping place, a departure from the EU rules may be permitted to the extent necessary to ensure the safety of persons, the vehicle or its load. Drivers must note all the reasons for doing so on the back of their tachograph record sheets (if using an analogue tachograph) or on a printout or temporary sheet (if using a digital tachograph) at the latest on reaching the suitable stopping place (see relevant sections covering manual entries). Repeated and regular occurrences, however, might indicate to enforcement officers that employers were not in fact scheduling work to enable compliance with the applicable rules.
A judgment by the European Court of Justice dated 9 November 1995 provides a useful guide to how this provision should be interpreted. It can apply only in cases where it unexpectedly becomes impossible to comply with the rules on drivers’ hours during the course of a journey. In other words, planned breaches of the rules are not allowed. This means that when an unforeseen event occurs, it would be for the driver to decide whether it was necessary to depart from the rules. In doing so, a driver would have to take into account the need to ensure road safety in the process (e.g. when driving a vehicle carrying an abnormal load under the Special Types regulations) and any instruction that may be given by an enforcement officer (e.g. when under police ■■■■■■).

Some examples of such events are delays caused by severe weather, road traffic accidents, mechanical breakdowns, interruptions of ferry services and any event that causes or is likely to cause danger to the life or health of people or animals. Note that this concession only allows for drivers to reach a suitable stopping place, not necessarily to complete their planned journey. Drivers and operators would be expected to reschedule any disrupted work to remain in compliance with the EU rules

Sometimes wish I was a copper, especially when I see muppets driving around with no seatbelts on their kids but hey ho that’s a whole other thread. And I never said you were daft, but you are the one who tried to take a break on a hard shoulder.

Its not a real hard shoulder it just looks like one :wink: wooley edge s/bound theres more trucks parked on it than there is on the actual services at times,anyway i got told to move so its the last time :cry:

the op was talking about Overnight rest I think.
I’ve parked on the on slip right at the beginning for a 15, 30 or a 45. had old bill pull up once and ask if all was ok and were fine about it … it was 2am though

So can the interpretation of ‘reach a suitable stopping place’ be used to travel to the next motorway services if there is no room available, or is it expected for people to pull off the motorway onto a roads to find somewhere…

Also see a lot in the car areas and coach areas of some MSA. Is this accepted if you’re out of time?

On a night trunk down to Surrey, I’ve stopped in the car section of Toddington a few times. Lorry park full of trampers. Never had any issue.
